f <br /> C. Divisions of land due to condemnation or <br /> • threat of condemnation by an agency or government vested <br /> with the power of condemnation are exempt from regulations <br /> of this ordinance. <br /> D. Nothing in this ordinance shall be construed <br /> to deprive any landowner of his right to divide his property <br /> for the purpose of creating open space, park and recrea- <br /> tion sites, historical preservation plots, and other sub- <br /> divisions of land which are prohibited from construction of <br /> residential dwellings by existing laws. <br /> SECTION III : Application Procedure (short subdivision) , <br /> A. All short subdivision applications shall be <br /> submitted to the Department of Community Development for <br /> review and tentative approval. <br /> Tentative approval, with specified alterations , <br /> or disapproving action will be taken by the Director of Commun- <br /> ity Development within thirty (30) days of the submission date <br /> unless the applicant consents to a time extension. <br /> Footnote: "Tentative approval" is the acceptance of the sub- <br /> division subject to acceptance of required improve- <br /> ments. <br /> B. Application: Short subdivision applications <br /> shall be submitted on a form provided for that purpose by <br /> the Department of Community Development, and shall contain <br /> and/or be accompanied by the following: <br /> 1. The application shall contain an ac- <br /> curate legal description of the area involved in the subdi- <br /> vision and the restrictive covenants, if any. Basis of bearings <br /> shall be stated. <br /> 2 . The application shall be accompanied <br /> by the short plat which shall be verified by and contain the <br /> original signature of a registered land surveyor, unless a <br /> variance from this signature requirement is granted by the <br /> City Engineer. The short plat shall be accurately scaled <br /> and dimensioned on 8-1/2 x 14" paper. The short plat shall <br /> contain courses, angles and distances, together with ties <br /> to appropriate monumentation acceptable to the City Engineer. <br /> Each lot shall have a number assigned to it, and its area <br /> in square feet shown. <br /> 3. The application shall contain or be accom- <br /> panied by an acknowledgement signed by all persons having <br /> any interest in the land being subdivided, showing that they <br /> are aware that an application to subdivide will be made. <br /> 4 . The application shall be accompanied <br /> by a Short Subdivision Certificate from a Snohomish County <br /> title company; said certificate to be dated not more than <br /> sixty (60) days prior to the date of application. <br /> 5. A separate drawing, shall accompany the <br /> application, which shall accurately show the total property <br /> being subdivided. All existing buildings on the property <br /> being subdivided must be accurately illustrated on the <br /> drawing, together with existing and proposed street, water, <br /> sewer and drainage system improvements. <br /> -2- <br />
