Where there have been no dedication to the public and no sales of any lots in a short subdivision, nothing contained in this 1 section shall prohibit a subdivider from completely withdrawing his entire short subdivision and thereafter presenting a new 2 application. 3 SECTION VII : Inspection Fee (short subdivision) , 4 An inspection fee will be required for each and every short subdivision hereafter applied for. The fee shall be paid to the 5 City Engineering Department prior to installation of any improve- ments in the short subdivision and shall be $15. 00 per lot in- 6 cluding, but not limited to: - lateral sewer system - lateral water system 8 - curb, gutter and sidewalk - closed drainage system 9 Said fee not to exceed $15 per lot. 10 SECTION VIII : Final Approval (short subdivision) , 11 Final approval of short subdivision may be given by the Director of Community Development provided the required improvements 12 have been completed, satisfactory to the City Engineer. 13 A. Said improvements may be deferred, subject to the approval of the City Engineer, for a period not to exceed one (1) 14 year from the date of tentative approval provided that a perfor- mance bond, satisfactory to the City Attorney, is posted in an 15 amount equal to 120% of the City Engineer ' s estimated cost of improvement. 16 B. The City Engineer and Director of Community De- velopment shall evidence that every requirement as herein set 17 forth, has been satisfactorily met; and their final acceptance of short subdivision by placing their signatures on the face of 18 the Short Plat. 19 C. The applicant (s) shall record the Short Plat and all other documents, as determined to be necessary by the Directo. 20 of Community Development, which as a minimum shall include; Short Subdivision Certificate, Legal Description, Declaration of Short 21 Subdivision. The applicant shall furnish a certified copy of the recorded documents to the Director of Community Development. 22 D. The short subdivision shall be considered final the 23 date and time the documents are recorded at the office of the Snohomish County Auditor, after requirements of this section have 24 been met. 25 SECTION IX: Council Review, If Agrieved (short subdivision) 26 Specific improvements and requirements provided for in this code shall not be waived; however to provide for reasonable inter- 27 pretation of the provisions of this code any applicant agrieved by the decision of the Director of Community Development and/or 28 the City Engineer may request review by the City Council. Such request must be made in writing to the City Clerk within ten 29 (10) working days :From the date the Director of Community De- velopment presents the applicant with the final decision in writ- 30 ing. 31 32 5
