ORDINANCE NO. 5 5 " Sr AN ORDINANCE providing for condemnation of certain 1 property in the City of Everett as required for the improvement of Peck's Drive from 2 Evergreen Way to Beverly Lane.,and declaring an emergency to exist. 3 4 WHEREAS, the City of Everett has determined, following all lawful 5 procedures, including SEPA, that certain improvements should be performed 6 to Pecks Drive from Evergreen Way to Beverly Lane, and 7 WHEREAS , a contract has been let for the construction of said 8 improvements, which contract is on file in the office of the City Clerk 9 10 of the City of Everett and may be examined at that office, and 11 WHEREAS, said improvements have required obtaining six foot 12 strips of property from abutting property owners for street purposes, including 13 but not limited to the installation of sidewalks and certain utilities and other 14 improvements, and 15 WHEREAS, said six foot strips have been obtained from abutting property 16 owners by negotiation except for two parcels of property, as stated in this 17 ordinance, and 18 19 WHEREAS, the last remaining two parcels of property are needed 20 for construction of said street improvements, 21 NOW, THEREFORE , THE CITY OF EVERETT DOES ORDAIN: 22 1. The public safety, necessity and convenience demand, and the City Council 23 so finds , that the following described property within the City of Everett, 24 Snohomish County, Washington shall be required for street purposes by 25 ,1 condemnation proceedings, if necessary, for the improvement of Pecks Drive 26 from Evergreen Way to Beverly Lane: 27 28 The South 6.0 feet of Lot 16, EXCEPT, that portion thereof lying West of a line drawn parallel to and 29 80 feet East of the West line of said Lot 16, Block 6, Beverly Hills Division No. 4, according to Plat 30 thereof recorded in Volume 10 of Plats, Page 97, Records of Snohomish County, Washington. 31 and 32
