ORDINANCE NO. r� /r- _7 1 AN ORDINANCE providing minimum standards to safeguard life or limb, health, property and public welfare; regulating and controlling the design construction, installation, quali- ty of materials, location, operation, and maintenance of heating ventilating, cooling, refrigeration systems, incinerators, water heating equipment and other miscellaneous heat producing appliances; providing for penalties for violation thereof; and pro- viding for the adoption by reference of the Uniform Mechanical Code as issued for the year 1973 by the International Association of Plumbing and Mechanical Officials and the International Conference of Building Officials as the Mechanical Ordinance of the City of Everett. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: The 1973 Edition of the Uniform Mechani- cal Code, including appendices A, B, and C, as prepared by the International Association of Plumbing and Mechanical Officials and the International Conference of Building Officials subject to the modifications, additions, and modifications hereinafter set forth, is adopted as the mechanical code and ordinance of the City of Everett and such code by reference is made a part of this chapter as though set forth fully at length herein. Three copies of said code shall be left on file with the City Clerk for use by the public and for reference. Section 1A: Whenever necessary to make an inspec- tion to enforce the city' s codes regulating the construc- tion, maintenance and repair of buildings and their appurtenances such as the Building Code, Housing Code, Dangerous Building Ordinance, Electrical Code and Fire Code, or whenever there is reasonable cause to believe there exists a violation of such ordinance or codes, the Fire Chief, Building Official or their authorized repre- sentatives may, upon presentation of their proper creden- tials enter such buildings or premises to inspect the same or to perform any duty imposed upon him by ordinance only after forty-eight hours of advance notice has been given by Certified Mail with requested return receipt outlining reasons and the time for inspection and stating that the property owner has the right to refuse entry subject to review by a court of competent jurisdiction, provided how- ever, this section shall not be applicable to emergency situations endangering the persons of property, and pro- vided further that the forty-eight hour advance notice may, in the discretion of the appropriate inspecting officer, be dispensed with in the inspection of buildings in which the general public is invited, or in the inspec- tion of buildings or structures under construction, repair, alteration or removal or in the inspection of any abandoned building. In the event the owner and/or occupant refuses entry after such request has been made, the official is hereby empowered to seek the assistance from any court of com- petent jurisdiction upon notice to said owner and occupant. -1-
