ORDINANCE NO. r� /r- _7 1 <br /> AN ORDINANCE providing minimum standards to <br /> safeguard life or limb, health, property and <br /> public welfare; regulating and controlling <br /> the design construction, installation, quali- <br /> ty of materials, location, operation, and <br /> maintenance of heating ventilating, cooling, <br /> refrigeration systems, incinerators, water <br /> heating equipment and other miscellaneous <br /> heat producing appliances; providing for <br /> penalties for violation thereof; and pro- <br /> viding for the adoption by reference of the <br /> Uniform Mechanical Code as issued for the <br /> year 1973 by the International Association <br /> of Plumbing and Mechanical Officials and the <br /> International Conference of Building Officials <br /> as the Mechanical Ordinance of the City of <br /> Everett. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: The 1973 Edition of the Uniform Mechani- <br /> cal Code, including appendices A, B, and C, as prepared <br /> by the International Association of Plumbing and Mechanical <br /> Officials and the International Conference of Building <br /> Officials subject to the modifications, additions, and <br /> modifications hereinafter set forth, is adopted as the <br /> mechanical code and ordinance of the City of Everett and <br /> such code by reference is made a part of this chapter as <br /> though set forth fully at length herein. Three copies of <br /> said code shall be left on file with the City Clerk for <br /> use by the public and for reference. <br /> Section 1A: Whenever necessary to make an inspec- <br /> tion to enforce the city' s codes regulating the construc- <br /> tion, maintenance and repair of buildings and their <br /> appurtenances such as the Building Code, Housing Code, <br /> Dangerous Building Ordinance, Electrical Code and Fire <br /> Code, or whenever there is reasonable cause to believe <br /> there exists a violation of such ordinance or codes, the <br /> Fire Chief, Building Official or their authorized repre- <br /> sentatives may, upon presentation of their proper creden- <br /> tials enter such buildings or premises to inspect the same <br /> or to perform any duty imposed upon him by ordinance only <br /> after forty-eight hours of advance notice has been given by <br /> Certified Mail with requested return receipt outlining <br /> reasons and the time for inspection and stating that the <br /> property owner has the right to refuse entry subject to <br /> review by a court of competent jurisdiction, provided how- <br /> ever, this section shall not be applicable to emergency <br /> situations endangering the persons of property, and pro- <br /> vided further that the forty-eight hour advance notice <br /> may, in the discretion of the appropriate inspecting <br /> officer, be dispensed with in the inspection of buildings <br /> in which the general public is invited, or in the inspec- <br /> tion of buildings or structures under construction, <br /> repair, alteration or removal or in the inspection of <br /> any abandoned building. <br /> In the event the owner and/or occupant refuses entry <br /> after such request has been made, the official is hereby <br /> empowered to seek the assistance from any court of com- <br /> petent jurisdiction upon notice to said owner and occupant. <br /> -1- <br />
