1 N <br /> 1 <br /> ORDINANCE NO. 332-74 <br /> 2 <br /> 3 <br /> AN ORDINANCE relating to art in ;the construction <br /> 4 of public works; requiring certain funds to <br /> be spent for art in public facilities and <br /> 5 providing for a review of capital project, <br /> and declaring an emergency to exist. <br /> 6 <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> 7 <br /> Section 1 : Purpose. The City of Everett accepts a responsibility <br /> 8 <br /> for expanding public experience with visual art. Artists capable <br /> 9 of creating art for public places must be encouraged. A policy <br /> 10 is established, therefore, to direct the inclusion of art in the <br /> public works of the City. <br /> 11 <br /> Section 2 : Definitions. <br /> 12 <br /> a. "Commission" means the Everett Civic Arts Commission. <br /> 13 b. "Municipal Construction Project" means any project, paid <br /> for wholly or in part by the City of Everett to construct <br /> 14 or remodel any building, decorative or commemorative <br /> structure, park, street, sidewalk, parking facility or <br /> 15 utility, or any portion thereof, within the limits of <br /> the City of Everett. <br /> 16 <br /> Section 3 : Works of art and public facilities . <br /> 17 <br /> a. All authorizations and/or appropriations for municipal <br /> 18 construction projects shall include an amount equal to <br /> at least 1% of the total project cost (as estimated by <br /> 19 the City in the year in which the project is approved <br /> by Council and bid is awarded for construction) to be <br /> 20 used for selection, acquisition, and/or installation of <br /> works of art to be placed in, on or about public facil- <br /> 21 ities. If the law establishing a source of funds for a <br /> particular project excludes art as one of the items for <br /> 22 which such funds may be expended, the amount of funds <br /> from that source shall be excluded from the "total-pro- <br /> 23 ject cost" in making said calculation. <br /> 24 b. The funds authorized and/or appropriated pursuant to this <br /> section may be held in the Municipal Arts Fund. Out of <br /> 25 such funds, the City Council , on the advice of the Com- <br /> mission, shall budget the amount to be allocated for <br /> 26 selection, acquisition and/or installation of individual <br /> works of art to be placed either as an integral part of <br /> 27 the municipal construction project or attached thereto, <br /> or detached within or outside such project, or to be <br /> 28 placed in, on or about other public facilities. <br /> 29 <br /> 30 <br /> 31 <br /> 32 <br />
