Funds authorized pursuant to an award of bid for the <br /> 2 project, pursuant to this section for a municipal <br /> construction project but not spent on that project <br /> 3 shall be placed in the Municipal Arts Fund. If the <br /> transfer to the Municipal Arts Fund is prohibited by <br /> 4 applicable law, funds authorized and/or appropriated <br /> pursuant to this section as a part of one such pro- <br /> 5 ject shall be spent either on that project, or within <br /> the department which is the source of the funds, which- <br /> 6 ever is permissible by law, for selection, acquisition, <br /> and/or installation of works of art. <br /> 7 <br /> Section 4 : Commission Responsibilities. <br /> 8 a. The Commission shall be responsible for determining <br /> 9 the method of selection and commissioning of artists <br /> for reviewing the design of, execution and placement <br /> 10 of, and acceptance of works of art funded by this <br /> ordinance; provided, however, those works of art <br /> 11 exceeding $10, 000. 00 shall be approved by the City <br /> Council prior to its selection. Procedures for these <br /> 12 responsibilities shall be developed by the Commission <br /> and shall become the policy of the Commission and as <br /> 13 such available to the public upon request. <br /> 14 b. The Commission shall make an annual review of all capital <br /> improvement projects with the Mayor and City Council <br /> 15 to determine which projects are appropriate for inclu- <br /> sion of works of art. If such inclusion is determined <br /> 16 not to be appropriate as to a given project, the funds <br /> allocated ahall be handled pursuant to Section 3 (c) <br /> 17 hereof. <br /> 18 c.
