Funds authorized pursuant to an award of bid for the 2 project, pursuant to this section for a municipal construction project but not spent on that project 3 shall be placed in the Municipal Arts Fund. If the transfer to the Municipal Arts Fund is prohibited by 4 applicable law, funds authorized and/or appropriated pursuant to this section as a part of one such pro- 5 ject shall be spent either on that project, or within the department which is the source of the funds, which- 6 ever is permissible by law, for selection, acquisition, and/or installation of works of art. 7 Section 4 : Commission Responsibilities. 8 a. The Commission shall be responsible for determining 9 the method of selection and commissioning of artists for reviewing the design of, execution and placement 10 of, and acceptance of works of art funded by this ordinance; provided, however, those works of art 11 exceeding $10, 000. 00 shall be approved by the City Council prior to its selection. Procedures for these 12 responsibilities shall be developed by the Commission and shall become the policy of the Commission and as 13 such available to the public upon request. 14 b. The Commission shall make an annual review of all capital improvement projects with the Mayor and City Council 15 to determine which projects are appropriate for inclu- sion of works of art. If such inclusion is determined 16 not to be appropriate as to a given project, the funds allocated ahall be handled pursuant to Section 3 (c) 17 hereof. 18 c.
