interest, may divide the amount due into equal annual in- stallments , subject to earlier payment at the option of the owner or party in interest, provided such install- ments shall be no less than $15.00 . B. If the building is removed or demolished under the direction of the Building Official, the Building Of- ficial may, if possible, sell the materials of such build- ings , provided that any such sale shall be upon the condi- tion that the building be forthwith demolished, the wreck- age and debris thereof removed and the lot cleaned. Any surplus from the sale of salvage materials from demolition, over and above the cost of demolition and cleaning the sites, shall be retained to be distributed to the parties or persons lawfully entitled thereto. " Section 3 : That Section 204 of the Uniform Building Code, 1973 Edition, be and hereby is amended to read as follows : "Section 204 - Board of Appeals In order to determine the suitability of alternate mater- ials and methods of construction and to provide for a rea- sonable interpretation of the provisions of this Code, there shall be and is hereby created a Board of Appeals, consisting of seven members who are qualified by exper- ience and training to pass upon matters pertaining to building construction. The Building Official shall be an ex officio member and shall act as Secretary of the Board. The Board of Appeals shall be appointed by the Mayor and shall hold office at his pleasure . The Board shall adopt reasonable rules and regulations for con- ducting its investigations and shall render all decisions and findings in writing to the Building Official with a duplicate copy to the appellant and may recommend to the City Council such new legislation as is consistent there- with. " Section 4 : That Section 205 of the Uniform Building Code, 1973 Edition, be and hereby is amended to read as follows : "Section 205 - Violations and Penalties It shall be unlawful for any person, firm or corporation to erect, construct, enlarge, alter, repair, move, im- prove, convert, demolish, or fail to demolish, equip, use, occupy, or maintain any building or structure in the City, or cause the same to be done, contrary to or in vio- lation of any of the provisions of this code. Any person, firm or corporation violating any of the provisions of this code shall be deemed guilty of a mis- demeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any of the provisions of this code is committed, continued, or permitted, and upon convic- tion of any such violation such person shall be punish- able by a fine of not more than $500 .00 , or by imprison- ment for not more than six months , or by both such fine and imprisonment. " Section 5: That Section 303 (b) of the Uniform Building Code, 1973 Edition be and hereby is amended to read as follows: "Section 303 (b) - Plan-Checking Fees When the valuation of the proposed construction exceeds $1, 000 . 00 and a plan is required to be submitted by Subsection (c) of Section 301, a plan-checking fee shall be paid to the Building Official at the time of submitting plans and specifications for checking .
