interest, may divide the amount due into equal annual in- <br /> stallments , subject to earlier payment at the option of <br /> the owner or party in interest, provided such install- <br /> ments shall be no less than $15.00 . <br /> B. If the building is removed or demolished under <br /> the direction of the Building Official, the Building Of- <br /> ficial may, if possible, sell the materials of such build- <br /> ings , provided that any such sale shall be upon the condi- <br /> tion that the building be forthwith demolished, the wreck- <br /> age and debris thereof removed and the lot cleaned. Any <br /> surplus from the sale of salvage materials from demolition, <br /> over and above the cost of demolition and cleaning the <br /> sites, shall be retained to be distributed to the parties <br /> or persons lawfully entitled thereto. " <br /> Section 3 : That Section 204 of the Uniform Building Code, <br /> 1973 Edition, be and hereby is amended to read as follows : <br /> "Section 204 - Board of Appeals <br /> In order to determine the suitability of alternate mater- <br /> ials and methods of construction and to provide for a rea- <br /> sonable interpretation of the provisions of this Code, <br /> there shall be and is hereby created a Board of Appeals, <br /> consisting of seven members who are qualified by exper- <br /> ience and training to pass upon matters pertaining to <br /> building construction. The Building Official shall be <br /> an ex officio member and shall act as Secretary of the <br /> Board. The Board of Appeals shall be appointed by the <br /> Mayor and shall hold office at his pleasure . The Board <br /> shall adopt reasonable rules and regulations for con- <br /> ducting its investigations and shall render all decisions <br /> and findings in writing to the Building Official with a <br /> duplicate copy to the appellant and may recommend to the <br /> City Council such new legislation as is consistent there- <br /> with. " <br /> Section 4 : That Section 205 of the Uniform Building Code, <br /> 1973 Edition, be and hereby is amended to read as follows : <br /> "Section 205 - Violations and Penalties <br /> It shall be unlawful for any person, firm or corporation <br /> to erect, construct, enlarge, alter, repair, move, im- <br /> prove, convert, demolish, or fail to demolish, equip, <br /> use, occupy, or maintain any building or structure in the <br /> City, or cause the same to be done, contrary to or in vio- <br /> lation of any of the provisions of this code. <br /> Any person, firm or corporation violating any of the <br /> provisions of this code shall be deemed guilty of a mis- <br /> demeanor, and each such person shall be deemed guilty of <br /> a separate offense for each and every day or portion <br /> thereof during which any of the provisions of this code <br /> is committed, continued, or permitted, and upon convic- <br /> tion of any such violation such person shall be punish- <br /> able by a fine of not more than $500 .00 , or by imprison- <br /> ment for not more than six months , or by both such fine <br /> and imprisonment. " <br /> Section 5: That Section 303 (b) of the Uniform Building <br /> Code, 1973 Edition be and hereby is amended to read as <br /> follows: <br /> "Section 303 (b) - Plan-Checking Fees <br /> When the valuation of the proposed construction exceeds <br /> $1, 000 . 00 and a plan is required to be submitted by <br /> Subsection (c) of Section 301, a plan-checking fee shall <br /> be paid to the Building Official at the time of submitting <br /> plans and specifications for checking . <br />
