ORDINANCE NO. 5 ,/ .� <br /> r , <br /> AN ORDINANCE amending Ordinance No. 233-73 <br /> (E .C .C. Chapter 4.76) to reduce the time <br /> 1 a service station is to remain unoccupied from one (1) <br /> year to six months, and adding penalty provisions. <br /> 2 <br /> 3 THE CITY OF EVERETT DOES ORDAIN as follows: <br /> 4 Section 1: <br /> 5 That Section 1 of Ordinance No. 233-73 (E.C .C . Section <br /> 6 <br /> 10.10.010) is hereby amended as follows: <br /> 7 <br /> "Whenever a service station ceases to be open for business <br /> 8 as a service station and is substantially unoccupied for <br /> a continuous period of twelve (12) months or more, <br /> 9 such non-operating and unoccupied service station is <br /> 10 hereby declared a public nuisance." <br /> 11 Section 2: <br /> 12 That Section 3 of Ordinance No. 233-73 (E.C .C. Section 10.10.030) <br /> 13 is hereby amended as follows: <br /> 14 "Occupancy of the premises for less than thirty (30) days shall <br /> 15 not be deemed to interrupt the twelve (12) months' vacancy <br /> unless such occupancy is accomplished by actual operation <br /> 16 of an automobile service station with normal and adequate <br /> inventories of motor vehicle fuel. <br /> 17 <br /> If prior to the twelve (12) months' vacancy limitation the owner <br /> 18 shall desire to convert the building or property to another <br /> 19 use such conversion must be approved by the City of <br /> Everett. Approval for such conversion may be obtained <br /> 20 only after it is determined that the structure and/or <br /> proposed use is in conformance to all codes and regulations governing <br /> 21 the proposed use. Proposed site arrangements including <br /> parking, landscaping, curb restoration, lighting, signing, <br /> 22 etc. must conform to code stipulation. <br /> 23 <br /> Occupancy of the site, premises, or building prior to obtaining <br /> 24 a Certificate of Occupancy from the Department of Community <br /> Development shall be considered as violating this <br /> 25 ordinance." <br /> 26 Section 3: <br /> 27 That Section 4 of Ordinance No. 233-73 (E .C .C . Section 10.10.040 <br /> 28 <br /> is hereby amended as follows: <br /> 29 <br /> "The Director of Community Development, or his authorized <br /> 30 agent, upon discovering a service station substantially <br /> unoccupied as described above for a continuous period of <br /> 31 <br /> 32 <br />
