t <br /> •• <br /> 1 twelve months or more shall give to the owner of <br /> such service station written notice stating that <br /> 2 the service station at the specified location has been unoccupied <br /> for a continuous period of twelve months and <br /> 3 thus constitutes a public nuisance. Such notice shall specify <br /> 4 that within 30 days from the date of this notice, unless <br /> otherwise stipulated by the Director of Community Development, <br /> 5 the service station shall either resume activities as an actual <br /> operating automobile service station with normal and adequate <br /> 6 inventories of motor vehicle fuel, or, in the alternative, the <br /> buildings and structures on the site specified in the notice <br /> 7 shall be demolished and removed together with the removal <br /> of all underground tanks and piping. Proper service of such <br /> 8 notice shall be by personal service upon the owner of record, <br /> 9 if he shall be found within the city limits. If he is not found <br /> within the city limits such service may be made upon said <br /> 10 owner by registered mail or certified mail, provided, that <br /> if such notice is by registered mail or certified mail, the <br /> 11 designated period within which said owner or person in <br /> charge is required to comply with the order of the Director <br /> 12 of Community Development, or his designee, shall begin as of <br /> the date he receives such notice." <br /> 13 <br /> 14 Section 4: <br /> 15 That Ordinance No. 233-73 (E .C .0 . Chapter 10.10) is hereby <br /> 16 amended by adding the following sections: <br /> 17 "Section 3 A: Removal of Advertising Material <br /> 18 <br /> Within not more than 30 days of the date that the station <br /> 19 becomes unoccupied the owner of the property shall <br /> remove all advertising signs, flags, banners, and similar <br /> 20 promotional display from the premises. <br /> 21 Storage of tires, automobile parts, used automobiles, <br /> oil drums, and similar related articles shall be <br /> 22 prohibited unless such articles are entirely enclosed <br /> 23 within a locked structure. <br /> 24 In the event the owner or party in interest fails to remove <br /> such articles and/or advertising display within the <br /> 25 30-day period, the City of Everett through appropriate <br /> departments shall cause the removal and the cost of such <br /> 26 removal shall be assessed against the real property <br /> 27 as provided by R.C .W. 35.80.030 (1) (h) . <br /> 28 <br /> 29 <br /> 30 <br /> 31 <br /> 32 <br />
