• <br /> • <br /> • . <br /> • <br /> • <br /> 1 <br /> Section 5: <br /> 2 <br /> That Ordinance No. 233-73 (E.C .0 . Chapter 10.10) is hereby <br /> 3 <br /> amended by adding the following section: <br /> 4 <br /> "Penalties <br /> 5 <br /> 6 (A) Any person wilfully violating or failing to comply with any <br /> provision of this chapter upon conviction thereof be <br /> 7 subject to a fine not exceeding five hundred dollars <br /> ($500.00) or imprisonment for a term not exceeding <br /> 8 six (6) months or both such fine and imprisonment. <br /> 9 (B) Each day that any violation of or failure to comply with <br /> 10 this chapter is committed or permitted to continue constitutes <br /> a separate and distinct offense under this section and is punishable <br /> 11 as such hereunder; provided, however, that the court <br /> may, in appropriate cases, stay the cumulation of penalties." <br /> 12 <br /> Section 6: <br /> 13 <br /> That Ordinance No. 233-73 (E .0 .0 . Chapter 10.10) is hereby <br /> 14 <br /> 15 amended by adding the following section: <br /> 16 "Separability <br /> 17 If any section, subsection, sentence, clause, phrase or portion <br /> of this chapter is for any reason held invalid, such holding <br /> 18 shall not affect the validity of the remaining portions <br /> 19 of this chapter." <br /> 20 Section 7: <br /> 21 That Ordinance No. 233-73 (E .0 .C. Chapter 10.10) is hereby <br /> 22 amended by adding the following section: <br /> 23 "That all service stations ceasing to be open for business <br /> 24 as a service station and are substantially unoccupied prior <br /> to February 1st, 1974, shall be governed by the one (1) <br /> 25 year non-operation provisions as set forth in the original <br /> ordinance No. 233-73 (E.C.C .
