ORDINANCE NO.., =,r ,. AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF 14TH AVENUE WEST LYING IN THE PLAT OF BEVERLY BERRY TRACTS DIV. #2 AND NORTH OF 80TH STREET S.W. WHEREAS, by Resolution No. 840 of the City of Everett, the City Council has declared its intentions to vacate said street, and WHEREAS, the City Council of the City of Everett did by resolution duly adopted, fix the 26th day of December, 1973, at 7:00 p.m. of said day, for the hearing, and determination of said Resolution, and, WHEREAS, due and legal notice of the time and place of said hearing and determination of said Resolution has been given by the City Clerk in the manner prescribed by law, and WHEREAS, at the time and place fixed for hearing favorable statements and objections to the vacating of the herein-described street were heard and discussed, and, WHEREAS, it now appears to the City Council of the City of Everett, that the portion of said street resolved to be vacated should be vacated, NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: All that portion of 14th Avenue West according to the Plat of Beverly Berry Traets Div. #2 as recorded in Volume 10, page 20, Records of Snohomish County, Washington lying adjacent to Lots 2, 7, 10, 15 and 1, 8, 9, and 16 of said plat and lying North of 80th Street S.W. be, and the same is hereby vacated. "Section 2: That this ordinance shall not become effective until the City and Cecil Cole, Trustee, execute an agreement whereby the developer agrees in the future to provide right-of-way property to the City at no cost.
