• <br /> * <br /> AGREEMENT <br /> WHEREAS, the undersigned developers desire vacation of 14th <br /> Street West (Cherry Way pursuant to Resolution No. 840; and <br /> WHEREAS, the City Council of the City of Everett, hereinafter <br /> called the "City, " has determined that the vacation of 14th Street is in <br /> the best interests of the traffic pattern for the Puget Sound Industrial <br /> Park area; and <br /> WHEREAS, the City Council has determined that the 37 ,900 feet <br /> vacated pursuant to the 14th Street vacation should be a minimum right-of- <br /> way available for traffic movement in the Puget Sound Industrial Park area, <br /> NCW, THEREFORE , the City and the developer do hereby agree <br /> as follows: <br /> 1 . The City of Everett shall consider an ordinance to vacate <br /> 14th Street West (Cherry Way) lying North of 80th Street SW within the <br /> Plat of Beverly Berry Tracts , Division #2, Section 11 , Township 28, R. 4 <br /> E.W.M. , Snohomish County, Washington, in the interests of the reasonable <br /> development of the City of Everett, and in particular, the Puget Sound <br /> Industrial Park area. <br /> 2 . In the event City Council passes an ordinance vacating said <br /> 14th Street West, the undersigned developer shall in the future provide <br /> right-of-way property to the City at no cost to meet the reasonable traffic <br /> requirements for the Puget Sound Industrial Park area in a minimum amount <br /> -1- <br />
