• <br /> • <br /> ORDINANCE NO. 2 ' I _ 7 3 <br /> AN ORDINANCE regulating unoccupied <br /> 1 automobile service stations. <br /> 2 <br /> 3 <br /> BE IT ORDAINED BY THE CITY OF EVERETT as follows: <br /> 4 <br /> 5 Section 1: Unoccupied Service Stations a Public Nuisance <br /> 6 Whenever a service station ceases to be open for business <br /> 7 as a service station and is substantially unoccupied for a continuous <br /> 8 period of one (1) year or more, such non-operating and <br /> 9 unoccupied service station is hereby declared a public nuisance. <br /> 10 <br /> Section 2: Definition of Service Station <br /> 11 <br /> The term "service station" as used herein shall mean any <br /> 12 <br /> premises used for the retail sale of motor vehicle fuel, minor accessories <br /> 13 <br /> 14 and services excluding minor and major automobile repair, for delivery <br /> 15 into the consuming vehicle on the premises . <br /> 16 Section 3: Occupancy of Premises <br /> 17 Occupancy of the premises for less than thirty (30) days shall not be <br /> 18 deemed to interrupt the one (1) year vacancy unless such occupancy is <br /> 19 <br /> accomplished by actual operation of an automobile service station with normal <br /> 20 <br /> and adequate inventories of motor vehicle fuel. <br /> 21 <br /> Section 4: Notice to Owner <br /> 22 <br /> 23 The Director of Community Development, or his authorized agent, upon <br /> 24 discovering a service station substantially unoccupied as described above for a <br /> 25 continuous period of one (1) year or more shall give to the owner of such <br /> 26 service station written notice stating that the service station at the specified <br /> 27 location has been unoccupied for a continuous period of one (1) year <br /> 28 <br /> and thus constitutes a public nuisance. Such notice shall specify that <br /> 29 <br /> within 90 days from the date of this notice, unless otherwise stipulated by the <br /> 30 <br /> 31 Director of Community Development, the service station shall either resume <br /> 32 <br />
