• <br /> • <br /> 1 activities as an actual operating automobile service station with normal <br /> 2 <br /> and adequate inventories of motor vehicle fuel, or, in the alternative, the <br /> 3 <br /> buildings and structures on the site specified in the notice shall be <br /> 4 <br /> 5 demolished and removed together with the removal of all underground tanks <br /> 6 and piping. Proper service of such notice shall be by personal service upon <br /> 7 the owner of record, if he shall be found within the city limits. If he is <br /> 8 not found within the city limits such service may be made upon said owner by <br /> 9 registered mail or certified mail, provided, that if such notice is by <br /> 10 <br /> registered mail or certified mail, the designated period within which said <br /> 11 <br /> owner or person in charge is required to comply with the order of the <br /> 12 <br /> Director of Community Development, or his designee, shall begin <br /> 13 <br /> 14 as of the date he receives such notice. <br /> 15 Section 4: Right to Demolish <br /> 16 In case the owner shall fail, neglect or refuse to comply with the notice <br /> 17 to actively operate a service station, or to demolish and remove <br /> 18 said buildings, tanks, or structure, or portion thereof, the City Council <br /> 19 <br /> may order the owner of the building prosecuted as a violator of the <br /> 20 <br /> provision of this code and may order the Director of Community Development, <br /> 21 <br /> or his designee, to proceed with the work specified in such notice. <br /> 22 <br /> 23 Section 5: Costs <br /> 24 The amount of the cost of such repairs, alterations or improvements, <br /> 25 vacating and closing, or removal, or demolition by the Director <br /> 26 of Community Development, or his designee, plus $250.00 administration <br /> 27 and collection fee costs, shall be collected from the owner by collection <br /> 28 <br /> procedures, including action of the debt and execution, or such costs may <br /> 29 <br /> be assessed against the real property upon which such cost was incurred unless <br /> 30 <br /> such amount is previously paid. <br /> 31 <br /> 32 A.
