IRC R105.1 Permit required, which reads: <br /> Any owner or authorized agent who intends to construct, enlarge, alter, repair, <br /> move, demolish or change the occupancy of a building or structure, or to erect, <br /> install, enlarge, alter, repair, remove, convert or replace any electrical,gas, <br /> mechanical or plumbing system, the installation of which is regulated by this code, <br /> or cause any such work to be done, shall first make application to the building <br /> official and obtain the required permit. <br /> 4. EMC §1.20.010(E) Repeat Violator: <br /> "Repeat violator"means any person, firm, corporation, association, or agent thereof <br /> who has had any order issued pursuant to the provisions in this chapter, including <br /> any order issued subsequent to a hearing, any stipulated order and any default <br /> order, and within twenty-four months of the issuance of such order commits or <br /> allows to be committed a new and separate violation of a same or similar chapter of <br /> the Everett Municipal Code that is enforceable under this chapter, regardless of <br /> location. <br /> 1 <br /> Conclusions of Law Based on Above Findings: <br /> 1. Construction activity conducted on property in the City of Everett without required <br /> City permits is a violation of IRC R105.1. The Respondent violated said City <br /> ordinance. <br /> 2. Unpermitted construction work conducted on the residential structure on the <br /> property is unlawful as defined by IPMC 108.1.4 and is a violation of IPMC 106.1. <br /> The Respondent violated said City ordinance. <br /> 3. The Respondent is a repeat violator with respect to violation of IPMC 106.1 and IRC <br /> R105.1 because the Hearing Examiner issued an Order within the past twenty-four <br /> months on same or similar violations. <br /> ORDER <br /> Based on the Findings of Fact and Conclusions of Law as stated above, it is hereby <br /> determined that the Respondent was in violation of IPMC 106.1 and IRC R105.1 and is <br /> hereby ordered to: <br /> 1.
