work and have the work inspected and approved by the City of Everett Building <br /> Division within 180 days from the date of the hearing or by August 16, 2017. <br /> Any violations not listed in this Order are subject to standard enforcement <br /> processes and procedures. <br /> 3. The Respondent is a repeat violator within twenty four months as defined by EMC <br /> §1.20.020 (E)(I). The Respondent is fined $1000.00 for each repeat violation of <br /> IPMC 106.1 and IRC R105.1 fora total fine of$2000.00. $1000.00 is suspended <br /> provided the Respondent applies for a City of Everett building permit by April 14, <br /> 2017. Once the permit application is approved by the City, the Respondent shall <br /> complete the work and have the work inspected and approved by the City of Everett <br /> Building Division by August 16, 2017. If the Respondent does not apply for the <br /> required City permits by March 16, 2017, the suspended portion of the fine shall be <br /> due to the City immediately. <br /> 4. The Respondent shall not violate any ordinance set forth in EMC §1.20.020 or any <br /> ordinance or regulation that identifies the enforcement procedure described in <br /> Chapter 1.20 EMC as the enforcement procedure for said regulations or ordinance, <br /> for the next twenty-four (24) months. <br /> 5. The Respondent shall pay the $1000.00 fine no later than March 3, 2017. Payment <br /> shall be made to the City of Everett Treasurer at 2930 Wetmore Suite 100, Everett <br /> Washington, 98201. If payment is not made on or before March 3, 2017, collection <br /> action will be taken, which may include assigning the debt to a collection agency <br /> pursuant to EMC §1.20.050(D). <br /> 6. This written Order shall be controlling over any conflicts with oral Orders issued at <br /> the Public Hearing. <br /> 7. If the Respondent fails to abate the identified violations as directed by this Order, <br /> the City of Everett is authorized to undertake and complete the abatement in <br /> 3 <br /> conformance with the provisions of the Everett Municipal Code, Chapter 1.20, at the <br /> full expense of the owner, which shall be in addition to the fines as imposed herein. <br /> The City may act without further order or direction of the Violations Hearing 1 <br /> Examiner. <br /> 8. Post hearing motions shall comply with the Rules of Procedure of the City of Everett I <br /> Hearing Examiner for Code Enforcement which can be found on the City of Everett <br /> website. <br /> 9. Any appeal of this Order must be filed in Superior Court and be made within twenty- <br /> one days of the issuance of this Order and comply with the procedures set forth in <br /> Chapter 36.70C of the Revised Code of Washington.
