(December 2016 CT GSP) <br /> Section 1-09.9 is supplemented with the following: <br /> APPLICATIONS FOR PAYMENT NEW <br /> For each application for payment the Contractor shall include the following additional <br /> documentation: <br /> a. A completed "Application and Certificate for Payment"form. "Application and <br /> Certificate of Payment" shall be submitted to Community Transit by the 5th of <br /> each month, and be based on the work completed for the previous month. <br /> b. Schedule update <br /> c. Certification that as-built drawings are current <br /> d. Certification of Payment to subcontractors and suppliers <br /> e. Provide copies of the 'Weekly Certified Payroll' with each monthly payment <br /> application. <br /> Final Application for Payment <br /> The final application for payment shall include the following additional documentation: <br /> a. A completed "Application and Certificate for Payment"form showing the Work <br /> 100% complete. <br /> b. An "Affidavit of Wages Paid"form for the Contractor and a form for each <br /> Subcontractor performing work on the project properly submitted to and <br /> approved and signed by the Washington State Department of Labor and <br /> Industries. <br /> c. As-Built Record Documents <br /> e. Warranties and Bonds <br /> 1-09.11 Disputes and Claims <br /> 1-09.11(3) Time Limitation and Jurisdiction <br /> (July 23, 2015 APWA GSP) <br /> Revise this section to read: <br /> For the convenience of the parties to the Contract it is mutually agreed by the parties that <br /> any claims or causes of action which the Contractor has against the Contracting Agency <br /> arising from the Contract shall be brought within 180 calendar days from the date of final <br /> acceptance (Section 1-05.12) of the Contract by the Contracting Agency; and it is further <br /> agreed that any such claims or causes of action shall be brought only in the Superior Court <br /> of the county where the Contracting Agency headquarters is located, provided that where <br /> an action is asserted against a county, RCW 36.01.05 shall control venue and jurisdiction. <br /> The parties understand and agree that the Contractor's failure to bring suit within the time <br /> period provided, shall be a complete bar to any such claims or causes of action. It is further <br /> mutually agreed by the parties that when any claims or causes of action which the <br /> Contractor asserts against the Contracting Agency arising from the Contract are filed with <br /> the Contracting Agency or initiated in court, the Contractor shall permit the Contracting <br /> Swift Green Line—Corridor Stations Special Provisions SP64 <br /> May 2017 <br />
