Reasonable accommodation, in the form of waiver of off-street <br /> parking requirements, is not necessary to provide housing equally to protected classes <br /> i <br /> under the Fair Housing Act. The Appellants have not shown that denial of a reasonable <br /> accommodation by the Planning Director was in error. Findings 3, 4, 5, 6, 7, and 8. I <br /> 3. City Staff was under the impression that the Appellants requested 17 rooms and 10 <br /> parking stalls,but Appellants'written appeal testimony clarifies that the request was for 1' <br /> 17 rooms with eight parking stalls and a modification to the approved site plan allowing <br /> retention of the detached garage, shown to be demolished on the approved site plan to 1 <br /> make room for two of the ten required spaces. It was not clear based on testimony where <br /> the communication breakdown occurred. The denial letter itself explained that the is <br /> Appellants could modify their request to better meet the requirements to justify <br /> reasonable accommodation,but it appeared that Appellants chose to proceed to appeal - <br /> rather than amend their proposal. The undersigned encourages both parties to meet outside of, and before resorting to, an <br /> appeal process in reaching mutual understanding as to what is proposed and what can be <br /> allowed, in order conserve both Appellant and City resources. <br /> a <br /> i <br /> DECISION <br /> Based on the foregoing findings and conclusions,the Appellants did not meet their burden of <br /> proving that the Planning Director's decision was in error. The appeal of the April 25,2017 <br /> i <br /> denial of the requested reasonable accommodation is DENIED.
