ORDINANCE NO. O1 Y y 1 AN ORDINANCE providing for the improvement of Sylvan Crest and certain adjoining areas on the Northerly and Easterly por- 2 tion, by the construction of a concrete sanitary sewer and nec- essary appurtenances to make a complete improvement, all in 3 accordance with the plans prepared by the City Engineer, creating a Local Improvement District fund therefore, and providing for the 4 payment for such improvement in part by special assessments on the property in said district under mode of payment by bonds or 5 installment notes , and declaring and emergency to exist. 8 WHEREAS by petition filed with the City Clerk of the City of Everett, a majority of the property owners , under the pro- 7 visions of RCW 35 . 43. 120 within the district in the title above- described have petitioned for construction of certain public 8 works and have set forth and met all requirements for petition- ing construction of said public works , and, 9 WHEREAS, the Council of the City of Everett find such 10 matters set forth in said petition to be true , and 11 WHEREAS , the City Council held a hearing on September 27 , 1972 following advertisement and public notice of the proposed 12 improvement, and thereafter directed that an ordinance be pre- sented, 13 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: 14 Section 1 : The City Council of the City of Everett finds 15 and declares that the improvements hereinafter described is in 16 the public interest and hereby directs its construction. 17 Section 2 : THAT AN IMPROVEMENT BE MADE OF : 18 (1) Juniper Drive, from approximately the South line of 19 Lot 2 , Block 1 to approximately 110 feet North of the South line of Lot 12 , Blockl. , and, 20 21 (2) Heather Way , from approximately 20 feet South of the South line of Lot 6 , Block 2 to approximately the North line of the South half of the East side of 22 Lot 5 , Block 4 , and, 23 (3) From Juniper Drive to Heather Way through the 24 South portion of Lot 9 , Block 2 and continuing to the Northwest corner of Lot 7 , Block 4 and con- tinuing along the North portion of Lot 7 , Block 4 25 to the intersection with a line in Heather Way , and, 26 (4) From the Southwest corner of Lot 12 , Block 3 to the 27 Northwest corner of Lot 7, Block 3 and, (5) From the Northwest corner of Lot 7 , Block 3 to a 28 point approximately 50 feet West of the East cor- 29 ner of Lot 19 , Block 4 , and, 30 (6) Yew Street from the North west corner of Lot 7 , Block 4 to the Northeast corner of Lot 15 , Block 3, 31 and, 32
