ORDINANCE NO. /97- 7 ) <br /> AN ORDINANCE adding a new section, Section <br /> 15. 04. 071, to the Everett City Code, dealing <br /> 1 with zoning, by pro:i-ding a procedure for the <br /> Board of Adjustment to approve Conditional Uses <br /> 2 of certain properties which uses are yet to be specified. <br /> 3 WHEREAS, the City Council of the City of Everett deem it advisabl: <br /> 4 upon the recommendation of the Planning Commission for the City of Everett <br /> 5 to establish a procedure for the approval of Conditional Uses,for certain <br /> 6 properties, and <br /> 7 WHEREAS, although the Planning Commission recommended that <br /> 8 the Planning Commission approve the Conditional Uses, the City Council on the <br /> 9 advice of the City Attorney deem it advisable for the Board of Adjustment <br /> 10 rather than the Planning Commission give the Conditional Uses approvals, <br /> 11 and <br /> 12 WHEREAS, the ordinance will only establish the Conditional Use <br /> 13 procedure and future ordinances will establish the land uses for which the <br /> 14 procedure is applicable, <br /> 15 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 16 Section 1: That a new section, Section 15. 04. 071, be added <br /> 17 to the Everett City Code as follows: <br /> 18 "15. 04. 071 - General Provisions - Conditional Uses <br /> 19 The purpose of Conditional Uses is to provide for specific, <br /> individual uses of specific, individual properties, or portions <br /> 20 thereof, which are compatible in certain zones. The Board <br /> of Adjustment will determine if proposed uses are compatible and <br /> 21 appropriate and it may make requirements and impose <br /> restrictions on the land uses, including time limitations, <br /> 22 to assure that the purposes and functions of the zones and of this <br /> Section are complied with. <br /> 23 Criteria for determining compatibility and appropriateness <br /> 24 shall include, but in the judgment of the Board of Adjustment <br /> need not be limited to <br /> 25 1. The need of the neighborhood, district or City for the uses. <br /> 26 2. The adequacy of public streets, utilities, and services to <br /> 27 accommodate the uses. <br /> 28 3. The density, time, and rate of change of occupancy. <br /> 29 4. The generation of pedestrian and vehicular traffic. <br /> 5. The generation of noises, odors, fumes, irritants, smoke, <br /> 30 visual pollution, etc. <br /> 31 6. The provision for off-street parking and the adequacy and <br /> 32 safety of vehicular ingress and egress. <br />
