• <br /> . <br /> ORDINANCE NO. + 7 <br /> AN ORDINANCE creating an additional zoning category <br /> under the City of Everett Comprehensive Zoning Code; <br /> establishing a Core Area Residential Zone - R-5; <br /> prescribing permitted uses, conditional uses, <br /> minimum lot size and width, yard requirements, and <br /> off-street parking requirements within said zone, <br /> and providing for penalties for violation of the ordinance. <br /> WHEREAS, the Planning Commission of the City of Everett held public <br /> hearings on the 21st day of December, 1971, and made recommendations to <br /> the City Council proposing a Core Area Residential Zone - R-5, and <br /> WHEREAS, the City Council of the City of Everett did approve said <br /> recommendations, <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: There is hereby created a zoning category designated as a <br /> Core Area Residential Zone - R-5, and said zone is hereby established as an <br /> additional zoning category to those previously designated in the City of Everett <br /> Comprehensive Zoning Ordinance. The City Council may by ordinance <br /> establish the boundaries of said zone in accordance with the procedures <br /> outlined in the Comprehensive Zoning Code of the City of Everett. The Core <br /> Area Residential Zone - R-5 is created and established in accordance with the <br /> following provisions: <br /> A. Declaration of Purpose: <br /> The purpose and function of the R-5 Zone is to provide and <br /> protect areas adjacent to the Central Business District for high <br /> density, high rise residential and compatible office uses. <br /> B. Permitted Uses: <br /> 1. R-4 Permitted Uses <br /> 2. Signs for R-4 Uses under R-4 Standards <br /> 3. Non-mercantile, office type uses when occupying less than <br /> 35% of the gross floor area of a professional office building. <br /> C. Conditional Uses: <br /> 1. Non-mercantile, office type uses occupying more than 35% of a <br /> non-residential building. <br /> 2. Non-mercantile, office type uses occupying any portion of a <br /> multiple family structure. <br /> D. Minimum Lot Size and Width: <br /> No lot shall contain less than 5000 square feet in area nor less than <br /> 50 feet in width. <br /> E. Yard Requirements: <br /> 1. There shall be a front yard setback of not less than ten (10) feet. <br /> 2. There shall be a side yard setback of not less than ten (10) feet <br /> on each side plus an additional three (3) feet on each side for <br /> each story more than three. The additional setback shall be <br /> permitted to commence with the fourth story of the building. <br /> 3. There shall be a rear yard setback of not less than twenty (20) <br /> feet. This requirement may be waived in the event that a comparable <br /> area is devoted to interior courtyard space. <br />
