ORDINANCE NO. /m AN ORDINANCE providing for the improvement of 51st Street Southwest, Elm Street to 520 feet West of Elm Street by the construction of a concrete sanitary sewer and necessary appurtenances to make a complete improvement, all in accordance with plans to be prepared by the City Engineer, creating a local improvement district fund therefore , and providing for the payment for said improvement in part by special assessments on the property in said district under mode of payment by bonds or installment notes . WHEREAS , by petition filed with the City Clerk of the City of Everett, a majority of the property owners , under the provisions of RCW 35 . 43 . 120 within the district in the title above described, have peti- tioned for construction of certain public works and have set forth and met all requirements for petition- ing construction of said public works , and, WHEREAS , the Council of the City of Everett finds such matter set forth in said petition to be true, and WHEREAS , the City Council held a hearing on February 23 , 1972 following advertisement and public notice of the proposed improvement, and thereafter directed that an ordinance be presented, • NOW, THEREFORE , THE CITY OF EVERETT DOES ORDAIN: Section 1: The City Council of the City of Everett finds and declares that the improvement hereinafter described is in the public interest and hereby directs its construction. Section 2: THAT AN IMPROVEMENT BE MADE OF; 51st Street Southwest, Elm Street to 520 feet West of Elm Street by the installation of 8-inch sanitary sewer system and necessary appurtenances ; said sys- tem to include all incidental material and work necessary for a complete improvement. All of the aforesaid improvements shall be in accord- ance with plans to be prepared by the City Engineer, which plans and specifications are hereby adopted and approved.
