1 <br /> 1 shall provide copies of the permit or verification letter to all subcontractors involved with the <br /> 2 authorized work prior to their commencement of any work in waters of the U.S. <br /> 3 <br /> 4 1-07.5(6) U.S. Fish/VVildlife Services and National Marine Fisheries•Service <br /> 5 The Contracting Agency will provide fish exclusion and handling services if the Work <br /> 6 dictates. However, if the Contractor discovers any fish stranded by the project and a <br /> 7 Contracting Agency biologist is not available, they shall immediately release the fish into a <br /> 8 flowing stream or open water. <br /> 9 <br /> 10 1-07.5(1) General <br /> 11 The first sentence is deleted and replaced with the following: <br /> 12 <br /> 13 No Work shall occur within areas under the jurisdiction of resource agencies unless I <br /> 14 authorized in the Contract. <br /> 15 <br /> 16 The third paragraph is deleted. <br /> 17 <br /> 18 1-07.5(2) State Department of Fish and Wildlife <br /> 19 This section is revised to read: <br /> 20 <br /> 21 In doing the Work, the Contractor shall: <br /> 22 <br /> 23 1. Not degrade water in a way that would harm fish, wildlife, or their habitat. <br /> 24 <br /> 25 2. Not place materials below or remove them from the ordinary high water line <br /> 26 except as may be specified in the Contract. <br /> 27 <br /> 28 3. Not allow equipment to enter waters of the State except as specified in the <br /> 29 Contract. I <br /> 30 <br /> 31 4. Revegetate in accordance with the Plans, unless the Special Provisions permit <br /> 32 otherwise. <br /> 33 <br /> 34 5. Prevent any fish-threatening silt buildup on the bed or bottom of any body of <br /> 35 water. <br /> 36 <br /> 37 6. Ensure continuous stream flow downstream of the Work area. <br /> 38 <br /> 39 7. Dispose of any project debris by removal, burning, or placement above high-water 111 <br /> 40 flows. <br /> 41 <br /> 42 8. Immediately notify the Engineer and stop all work causing impacts, if at any time, <br /> 43 as a result of project activities, fish are observed in distress or a fish kill occurs. <br /> 44 <br /> 45 If the Work in (1) through (3) above differs little from what the Contract requires, the 1 <br /> 46 Contracting Agency will measure and pay for it at unit Contract prices. But if Contract items <br /> 47 do not cover those areas, the Contracting Agency will pay pursuant to Section 1-09.4.
