C suis 6- 7/ <br /> ORDINANCE NO. /1-if- / <br /> AN <br /> `7- f- <br /> AN ORDINANCE regulating and licensing the business <br /> of conveying physically and mentally handicapped <br /> passengers for hire; fixing the rates therefore; <br /> defining offenses and prescribing penalties, and <br /> declaring an emergency to exist. <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: The following terms for the purpose of this ordinance shall mean: <br /> "CABULANCE": - Any motor vehicle for hire driven by the owner <br /> or his employee and which is designed for the transportation of <br /> handicapped persons who by reason of physical or mental <br /> infirmity may not be conveniently transported on public mass <br /> transportation vehicles or in taxicabs or who cannot drive their <br /> own automobile. This definition shall not be construed to <br /> include taxicabs, ambulances, or mass transportation vehicles. <br /> "CABULANCE OPERATOR": - Anyone engaged in the business of <br /> transporting physically or mentally infirm persons in a "cabulance. " <br /> "DRIVER": - Anyone in charge of or driving any cabulance. <br /> Section 2: It shall be unlawful to be or become a "cabulance operator" in the <br /> City of Everett without first having obtained a valid and subsisting "Cabulance <br /> Operator's Base License, " the annual fee for which is hereby fixed at $100. 00 <br /> and the expiration date for which is hereby fixed as December 31st of each year; <br /> and it further shall be unlawful for any cabulance operator to operate, or any <br /> driver to drive, any cabulance unless said cabulance operator shall first have <br /> obtained for each said vehicle a valid and subsisting "cabulance license, " the <br /> annual fee which shall be $25. 00 and the expiration date for which shall be December <br /> 31st of each year. Any licenses which may be issued under this ordinance prior <br /> to January 1st shall be prorated and issued for a fee equal of one-twelveth of the <br /> annual license fee for said license multiplied by the number of full months which may <br /> remain in said period. <br /> Section 3: Application for a Cabulance Operator's Base License shall be made <br /> to the City Clerk on forms provided by him and said application shall be verified <br /> under oath and shall furnish the following information: <br /> (A) The name and address of the applicant, together with <br /> any assumed name under which the applicant will operate. <br /> (B) The financial status of the applicant, including the amounts <br /> of all unpaid judgments against the applicant and the nature of <br /> the transaction or acts giving rise to said judgments. <br /> (C) The experience of the applicant in the transportation of <br /> pass engers. <br /> (D) Any facts which the applicant believes to him to prove that <br /> public convenience and necessity require the granting of a <br /> license. <br /> (E) The number of vehicles to be operated or controlled by the <br /> applicant and the location of proposed depots and terminals. <br />
