C suis 6- 7/ ORDINANCE NO. /1-if- / AN `7- f- AN ORDINANCE regulating and licensing the business of conveying physically and mentally handicapped passengers for hire; fixing the rates therefore; defining offenses and prescribing penalties, and declaring an emergency to exist. THE CITY OF EVERETT DOES ORDAIN: Section 1: The following terms for the purpose of this ordinance shall mean: "CABULANCE": - Any motor vehicle for hire driven by the owner or his employee and which is designed for the transportation of handicapped persons who by reason of physical or mental infirmity may not be conveniently transported on public mass transportation vehicles or in taxicabs or who cannot drive their own automobile. This definition shall not be construed to include taxicabs, ambulances, or mass transportation vehicles. "CABULANCE OPERATOR": - Anyone engaged in the business of transporting physically or mentally infirm persons in a "cabulance. " "DRIVER": - Anyone in charge of or driving any cabulance. Section 2: It shall be unlawful to be or become a "cabulance operator" in the City of Everett without first having obtained a valid and subsisting "Cabulance Operator's Base License, " the annual fee for which is hereby fixed at $100. 00 and the expiration date for which is hereby fixed as December 31st of each year; and it further shall be unlawful for any cabulance operator to operate, or any driver to drive, any cabulance unless said cabulance operator shall first have obtained for each said vehicle a valid and subsisting "cabulance license, " the annual fee which shall be $25. 00 and the expiration date for which shall be December 31st of each year. Any licenses which may be issued under this ordinance prior to January 1st shall be prorated and issued for a fee equal of one-twelveth of the annual license fee for said license multiplied by the number of full months which may remain in said period. Section 3: Application for a Cabulance Operator's Base License shall be made to the City Clerk on forms provided by him and said application shall be verified under oath and shall furnish the following information: (A) The name and address of the applicant, together with any assumed name under which the applicant will operate. (B) The financial status of the applicant, including the amounts of all unpaid judgments against the applicant and the nature of the transaction or acts giving rise to said judgments. (C) The experience of the applicant in the transportation of pass engers. (D) Any facts which the applicant believes to him to prove that public convenience and necessity require the granting of a license. (E) The number of vehicles to be operated or controlled by the applicant and the location of proposed depots and terminals.
