IPMC 4043 Minimum Ceiling Heights,which reads: <br /> 11 <br /> Habitable spaces, hallways, corridors, laundry areas, bathrooms, toilet rooms and habitable <br /> basement areas shall have a minimum clear ceiling height of 7feet(2134 mm). <br /> 4. IPMC 704.2 Single-and Multiple-Station Smoke Alarms,which reads: <br /> Single-and multiple-station smoke alarms shall be installed in existing Group I-1 and R <br /> occupancies in accordance with Sections 704.2.1 through 704.2.3. <br /> 5. IRC R105.1 Permit required,which reads: <br /> Any owner or authorized agent who intends to construct, P <br /> enlarge, alter, repair, move, <br /> demolish or change the occupancy of a building or structure, or to erect, install, enlarge, <br /> alter, repair, remove, convert or replace any electrical, gas, mechanical or plumbing <br /> system, the installation of which is regulated by this code, or cause any such work to be <br /> done, shall first make application to the building official and obtain the required permit. <br /> Other Applicable Law: <br /> 1. IPMC 108.1.4 Unlawful Structure,which reads: <br /> An unlawful structure is one found in whole or in part to be occupied by more persons than <br /> permitted under this code, or was erected, altered or occupied contrary to law. <br /> 2. IPMC 108.1.5(10)Dangerous Structure or Premises,which reads: <br /> For the purpose of this code, any structure or premises that has any or all of the conditions <br /> or defects described below shall be considered dangerous: <br /> *** <br /> (10)Any building or structure, because of a lack of sufficient or proper fire-resistance-rated <br /> construction,fire protection systems, electrical system,fuel connections, mechanical <br /> system,plumbing system or other cause, is determined by the code official to be a threat <br /> to life or health. <br /> *** <br /> Conclusions of Law Based on Above Findings: <br /> 1. Construction activity conducted on a property within the City of Everett without required <br /> City permits renders the structure unlawful as defined by IPMC 108.1.4 and is a violation of <br /> IPMC 106.1 and IRC R105.1. The record demonstrates said City ordinances were violated. <br /> 2. The inadequate fire safety construction alterations conducted renders the structure dangerous <br /> as defined by IPMC 108.1.5 (10)and is a violation of IPMC 106.1. The record <br /> demonstrates said City ordinance was violated. <br /> 3. An exterior stairway servicing the residential structure was in a deteriorated condition and is <br /> a violation of IPMC 304.10.
