4. The basement dwelling unit lacks the minimum ceiling height of 7 feet for occupancy and is a violation of IPMC 404.3. The record demonstrates said City ordinance was violated. 5. Missing smoke and carbon monoxide alarms and/or non-functioning smoke and carbon monoxide alarms in an occupied residential structure is a violation of IPMC 704.2. The record demonstrates said City ordinance was violated. ORDER Based on the findings of fact and conclusions of law stated above,it is hereby concluded that the Respondent allowed violation of IPMC 106.1,IPMC 304.10, IPMC 404.3,IPMC 704.2,and IRC R105.1 on the subject property and is hereby ordered as follows: 1. The Respondent must abate all violations of IPMC 106.1,IPMC 304.10,IPMC 404.3, IPMC 704.2,and IRC R105.1 on property located at 1517 Broadway,Everett,Washington. 2. Abatement shall include the following: a. The five dwelling units within the residential structure on the subject property must remain vacant and may not be used for any occupancy unless and until approved by the City of Everett Building and Planning Departments. b. The Respondent shall apply for and obtain all of the necessary and required permits to bring the property into compliance with City ordinances. The Respondent shall have a qualified contractor conduct and complete all of the required work,and shall have the work inspected and approved by the City of Everett Building Division within 180 days or by November 12,2018. • c. Any violations not listed in this Order are subject to standard enforcement processes and procedures. 3. The Respondent shall be fined$500.00 for each violation of IPMC 106.1,IPMC 304.10, IPMC 404.3,IPMC 704.2,and IRC R105.1 for a total fine of$2500.00. Of the total fine, $2000.00 shall be suspended provided the Respondent comply with items 2a-2b of this Order by November 12,2018. If compliance has not been met by November 12,2018 or if a same or similar violation occurs within 24 months,the suspended portion of the fme shall be due immediately to the City. 4. The Respondent shall pay the$500.00 non-suspended fine no later than May 25,2018. Payment shall be made to the City of Everett Treasurer at 2930 Wetmore Suite 100,Everett -Washington,98201. Ifpayment is not made on or before May 25 2018 collection action I will be taken,which may include assigning the debt to a collection agency pursuant to EMC 1.20.050(D). 5. If the Respondent fails to abate the identified violations as directed by this Order,the City of Everett is authorized to undertake and complete the abatement in conformance with the provisions of the Everett Municipal Code, Chapter 1.20,at the full expense of the owner,
