t
Therefore, the applicant wishes to add a six foot by eight
foot section to an existing pole sign abutting the 19th
Ave. S.E. right of way and list the names of the business[
establishments on that sign.
b. Conclusion #1: There are exceptional circumstances
applying to the subject property that do not
generally to other property in the vicinity.
Criterion No. 2. That such variance is necessary for the preservation and
joyment of a substantial property right of the appellant pos sessed by
owners of other properties in the same vicin ity or zone.
a. Finding #2: Since the property is located directly
across the street from an area zoned B-2, where there is
no limit on height or size of signs, granting the variance
would allow a property right possessed by others in the
vicinity. The Board has granted variances in the past to
applicants whose property was located in a B-1 zone which
was directly across the street from a B-2 zone.
b. Conclusion #2: Granting this variance would allow the
applicant a property right possessed by others in the
vicinity.
Criterion No. 3. That the authorization of such variance will not be materi'
ally detrimental to the public welfare or injurious to prop erty in the
vicinity or zone in which the property is to cated.
a. Finding #3: There have been no adverse comments received
in response to notices sent to property owners in the area
and there were no adverse comments from the Public Works
Department.
b. Conclusion #3: It does not appear thaw there would be any
adverse affect on other property owners in the vicinity',
and zone if this variance is granted.
I I
(Criterion No. 4. That the granting of such variance will not adversely affect;
the Comprehensive General Plan.
i
a. Finding #4: The Comprehensive Plan designation for this
property is Highway Commercial and the property across'
the street which is currently zoned B-2 is also designated
Highway Commercial and so it would be reasonable to have
I the same sign requirements on both sides of the street.
I
b. Conclusion #4: Granting this variance would not adversely
affect the comprehensive plan.
I;
IIRECOMMENDATION:
I i
APPROVE the variance as requested by applicant with the following conditions.
;1. Obtain a sign permit.
2. The free standing sign adjacent to the driveway on the south shall be reroved.
3. Wall or projecting signs shall not be permitted on the front walls of each
separate business establishment since this variance for a larger pole sign
has been granted in lieu of the separate sign for each business.
'-c f' :min '✓, l//,F:/_.'/
Prepared by ?
Reviewed by'
