t <br />Therefore, the applicant wishes to add a six foot by eight <br />foot section to an existing pole sign abutting the 19th <br />Ave. S.E. right of way and list the names of the business[ <br />establishments on that sign. <br />b. Conclusion #1: There are exceptional circumstances <br />applying to the subject property that do not <br />generally to other property in the vicinity. <br />Criterion No. 2. That such variance is necessary for the preservation and <br />joyment of a substantial property right of the appellant pos sessed by <br />owners of other properties in the same vicin ity or zone. <br />a. Finding #2: Since the property is located directly <br />across the street from an area zoned B-2, where there is <br />no limit on height or size of signs, granting the variance <br />would allow a property right possessed by others in the <br />vicinity. The Board has granted variances in the past to <br />applicants whose property was located in a B-1 zone which <br />was directly across the street from a B-2 zone. <br />b. Conclusion #2: Granting this variance would allow the <br />applicant a property right possessed by others in the <br />vicinity. <br />Criterion No. 3. That the authorization of such variance will not be materi' <br />ally detrimental to the public welfare or injurious to prop erty in the <br />vicinity or zone in which the property is to cated. <br />a. Finding #3: There have been no adverse comments received <br />in response to notices sent to property owners in the area <br />and there were no adverse comments from the Public Works <br />Department. <br />b. Conclusion #3: It does not appear thaw there would be any <br />adverse affect on other property owners in the vicinity', <br />and zone if this variance is granted. <br />I I <br />(Criterion No. 4. That the granting of such variance will not adversely affect; <br />the Comprehensive General Plan. <br />i <br />a. Finding #4: The Comprehensive Plan designation for this <br />property is Highway Commercial and the property across' <br />the street which is currently zoned B-2 is also designated <br />Highway Commercial and so it would be reasonable to have <br />�I the same sign requirements on both sides of the street. <br />�I <br />b. Conclusion #4: Granting this variance would not adversely <br />affect the comprehensive plan. <br />I; <br />IIRECOMMENDATION: <br />I i <br />APPROVE the variance as requested by applicant with the following conditions. <br />;1. Obtain a sign permit. <br />2. The free standing sign adjacent to the driveway on the south shall be reroved. <br />3.
