• <br /> • <br /> Review Board, and shall keep the records of the Fire Prevention <br /> Review Board, its sessions, the dates thereof, the members <br /> present and the witnesses heard giving testimony in each particular <br /> case. <br /> 3. Steps on Appeal -- Any person upon whom such Fire Marshal <br /> Order has been served who desires to appeal the order therein set <br /> forth and review such order may do so, so long as such person shall <br /> comply with each and every step herein set forth, which jurisdictional <br /> steps are as follows: <br /> (a) File two copies of notice of appeal with the City <br /> Clerk of the City of Everett within five days after <br /> service of said Fire Marshal Order; and <br /> (b) Post the sum of $25. 00 with the City Clerk to cover <br /> cost of appeal. <br /> 4. In the event that any such person seeking a review before the Fire <br /> Prevention Review Board fails to comply with all of the steps <br /> herein set forth, then any member of said Fire Prevention Review <br /> Board or the City Attorney for the City of Everett may dismiss such <br /> appeal upon motion and if all of the steps for appeal have not been <br /> complied with, the appeal of such party shall be dismissed by the <br /> Fire Prevention Review Board. <br /> 5. If such appeal is properly taken, the Fire Prevention Review <br /> Board shall, within seven days, review such order and file their <br /> decision thereon. All members of the Fire Prevention Review Board <br /> shall have a vote in arriving at such decision, except the City Clerk, <br /> and in the event such order is sustained by a majority of the Fire <br /> Prevention Review Board, it shall be forthwith complied with, or <br /> as modified by the Fire Prevention Review Board if such modification <br /> order is entered. Unless by the authority of the Fire Prevention <br /> Review Board such order is revoked or modified, it shall remain in <br /> full force and effect and be complied with within the time fixed in <br /> said order or decision of the Fire Prevention Review Board. All <br /> decisions of the Fire Prevention Review Board shall be final, <br /> conclusive and binding upon the parties. <br /> Section 4: Establishment of Bureau of Fire Prevention. <br /> The Bureau of Fire Prevention is hereby created, which Bureau shall <br /> enforce the provisions of the Fire Prevention Code. The Fire Marshal shall be <br /> the Chief of the Bureau of Fire Prevention and shall take his orders from the <br /> Chief of the Fire Department. <br /> Page 5 <br />
