• <br /> Section 10: New Materials, Processes or Occupancies Which May Require <br /> Permits. <br /> The Chief of the Fire Department and the Chief of the Bureau of Fire <br /> Prevention shall act as a committee to determine and specify, after giving affected <br /> persons an opportunity to be heard, any new materials, processes or occupancies, <br /> which shall require permits, in addition to those now enumerated in said code. <br /> The Chief of the Bureau of Fire Prevention shall post such list in a conspicuous <br /> place in his office, and distribute copies thereof to interested parties. <br /> Section 11: Penalties. <br /> Any person who shall violate any of the provisions of the code hereby adopted <br /> or fail to secure a permit or perform any of the activities herein provided without <br /> securing a permit or having a permit in full force and effect, or who shall fail <br /> to comply with the orders of the Fire Marshal and/or the decision of the Fire <br /> Prevention Review Board in case of appeal, shall be severally for each and every <br /> violation and non-compliance respectively be guilty of a violation of this ordinance <br /> and shall be punished by a fine of not more than $500. 00 or by imprisonment for <br /> not more than six months in the city jail or by both such fine and imprisonment. <br /> The imposition of one penalty for a violation shall not excuse the violation or <br /> permit it to continue and all such persons to whom the Fire Marshal Order has <br /> been issued shall be required to correct or remedy such violation or defect within the <br /> time set forth in such order and/or after such order has been affirmed or modified <br /> or the appeal period has elapsed for reviewing such order. Each ten days that <br /> prohibited conditions are maintained or a person shall continue to coperate <br /> without a permit shall constitute a separate offense. <br /> The application of the above penalty by whatever action the City of Everett <br /> shall take shall not be held to prevent the enforced removal of the prohibited <br /> conditions. <br /> Section 12: Validity. <br /> The City of Everett hereby declares that should any section, paragraph, <br /> sentence or word of this ordinance or of the code hereby adopted be declared <br /> for any reason to be invalid, it is the intent of the City of Everett that it would <br /> have passed all other portions of this ordinance independent of the elimination <br /> herefrom of any such portion as may be declared invalid. <br /> Section 13: Repeal of Sections. <br /> Ordinance No. 4114 and Ordinance No. 4324, Everett City Code Sections <br /> 7. 04. 010 through 7. 04. 130, are hereby repealed. <br /> ATTEST: &Lk- (*°- <br /> 61 I-- <br /> MAYOR <br /> I. ►, �� <br /> DEPUT'V '1 y er <br /> Passed: '/ 7 ' ?/ <br /> Valid: —I 7 <br /> Published: E. _/ �_-� / Page 7 <br />
