<br /> Based upon a review of the above record, the following Findings of Fact and
<br /> Conclusions of Law hereby constitute the basis of the decision of the City of Everett
<br /> Violations Hearing Examiner.
<br /> FINDINGS OF FACT
<br /> 1. Stephen Winecoff(Respondent) is the owner of record of property at 1211 East
<br /> Marine View Drive, Everett, Washington (property) and Scott R. Bacon
<br /> (Respondent) is a tenant and manager of the property. The property is in an R-2
<br /> Single Family Detached Medium Density zone and is developed with a one and one
<br /> half story single family residence and a detached garage. (Exhibit#8, Snohomish
<br /> County Assessor's Record dated January 9, 2012) (Exhibit#9, Go Sync Map)
<br /> 2. During a site inspection on November 2, 2011, City of Everett Code Enforcement
<br /> Officer Tamra Gregory observed and photographed a trailer being salvaged, loose
<br /> wires hanging from the garage, a pile of junk including lumber, tires, signs, dead and
<br /> decaying vegetation, garbage, trash and litter, discarded on the property. (Exhibit

<br /> 3. During the November 2, 2011 inspection, Code Officer Gregory was informed by
<br /> Chase Thomas, a tenant, that he was remodeling the house for the owner. Code
<br /> Officer Gregory searched the City of Everett building permit records and discovered
<br /> there were no active permits had been issued for the property by the City of Everett.

<br /> 4. On November 7, 2011, the City issued the Respondent, Stephen Wincoff, a written
<br /> notice requiring abatement and correction of the following conditions on the property:
<br /> junk, trash, litter, broken furniture, dead and decaying vegetation and vehicle parts
<br /> discarded in the yards. The notice also required the Respondent to secure
<br /> necessary permits for any construction work being done on the house. The deadline
<br /> for compliance was November 28, 2011. (Exhibit#5, Warning Letter dated

<br /> 5. On November 28, 2011, Code Officer Gregory met the Respondent, Scott R. Bacon,
<br /> on the property and observed and photographed lumber, roofing materials, broken
<br /> furniture, tires, a large pile of dead and decaying vegetation, trash, and litter
<br /> discarded on the property. Mr. Bacon informed Code Officer Gregory that he was in
<br /> charge of the remodel and that permits were being sought by the owner. (Exhibit

<br /> 6. During the inspection on November 28, 2011, Code Officer Gregory also observed
<br /> and photographed recently installed drywall in the kitchen area. She searched City
<br /> of Everett building permit records and discovered that no permits had been issued
<br /> for this property. However, upon consultation with the City's Building Division, due
<br /> to the scope of the work disclosed at that time it was determined permits at the City's
