On November 29, 2011, the City of Everett Code Enforcement Unit again issued a <br /> written notice requiring the Respondents to abate and correct the following <br /> conditions: junk, trash, litter, broken furniture, dead and decaying vegetation and <br /> vehicle parts discarded on the property. On that same day, the Code Enforcement <br /> Unit was notified by the City of Everett Police Department that during a recent visit to <br /> the site they had observed hazardous electrical wiring, a toilet plumbed into a crawl <br /> space, and improper egress for the upstairs tenants. (Exhibit#6, Warning Letter <br /> dated November 29, 2011) (Testimony of Code Enforcement Officer Gregory) <br /> 8. On December 5, 2011, the City issued the Respondents a violation citation for the <br /> following conditions: junk, trash, titter, salvage materials, broken furniture, dead and <br /> decaying vegetation and vehicle parts discarded on the property; hazardous <br /> electrical inside and outside; modifications/alterations to a structure without benefit <br /> of permits; and improper egress. The Respondents were notified of these additional <br /> conditions via first class, and certified return receipt mail on December 5, 2011. The <br /> egress was illegal because the locks on the second floor had a double key lock <br /> system which is prohibited in the City of Everett. (Exhibit#4, Violation Citation dated <br /> December 5, 2011 with mail receipts) (Testimony of Code Enforcement Officer <br /> Gregory) <br /> 9. During a prehearing inspection on January 3, 2012, Code Officer Gregory observed <br /> and photographed discarded roofing materials, broken furniture,junk, household <br /> items, lumber, dead and decaying vegetation, and vehicle parts discarded on the <br /> property. She was informed by Respondent, Scott R. Bacon, that they were hauling <br /> things to the dump and that the property owner had secured building permits. <br /> (Exhibit#9a-9e, Pre-Hearing Inspection Photos dated January 3, 2012) (Testimony <br /> of Code Enforcement Officer Gregory) <br /> 10.Code Officer Gregory received an email from the City of Everett Building Division <br /> advising there were no current permits, or application for permits, and there has <br /> been no permit activity on the property since the early 1990's. (Exhibit#7, Email <br /> from Jessie Patterson, City of Everett Building Department dated January 4, 2012) <br /> (Testimony of Code Enforcement Officer Gregory) <br /> Based on the above Findings of Fact, the Violations Hearing Examiner enters the <br /> following Conclusions: <br /> CONCLUSIONS OF LAW <br /> Jurisdiction: <br /> The Violations Hearing Examiner of the City of Everett has jurisdictional authority to <br /> hold a hearing and to issue the decision EMC §1.20.020. <br />
