ORDINANCE NO. 96- 74 <br /> AN ORDINANCE amending Everett City Code Sections 15 .04 .070 <br /> (Ordinance No. 3572 , Section 5) and 15 .05. 190 (Ordinance <br /> No. 3572 , Section 17) , dealing with zoning, special property <br /> use , and off-street parking and loading requirements . <br /> WHEREAS , the Planning Commission of the City of Everett held <br /> public hearings on the 21st day of July , 1970 , and made recom- <br /> mendations to the City Council proposing certain changes in the <br /> Zoning Ordinance , and <br /> WHEREAS, the City Council of the City of Everett approve said <br /> recommendations , <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> SECTION 1: That Everett City Code , Section 15 .04.070 (Ordinance <br /> No. 3572 , Section 5) is hereby amended to read as follows : <br /> "15 .04. 070 GENERAL PROVISIONS-SPECIAL PROPERTY USE <br /> The following uses , because of the large land area associated <br /> with their needs and the importance of their location to the <br /> Comprehensive Plan or to public convenience and necessity, <br /> shall be considered only after a public hearing held by the <br /> Planning Commission. The Planning Commission before recommend- <br /> ing to the City Council either for or against the proposed use <br /> shall determine whether or not the proposed use is detrimental <br /> to the General Comprehensive Plan, adjacent and surrounding <br /> properties , the ecology and/or environment of the Community. <br /> If the proposed use is recommended by the Planning Commission <br /> and approved by the City Council , the Planning Director shall <br /> sign the Special Property Use Permit and shall stipulate off- <br /> street parking requirements and set-back distances . Any other <br /> reasonable conditions may be stipulated by the Planning Commis- <br /> sion and/or the City Council including but not limited to green- <br /> belts , sight obscuring screening, access controls , and similar <br /> siting factors . <br /> The Planning Commission may recommend and the City Council may <br /> stipulate a time limit for initiation and/or completion of the <br /> project. If a substantial start has not been made within the <br /> initiation time limit , the City Council may declare the Spe- <br /> cial Property Use Permit null and void. If a completion time <br /> limit is stipulated by the Council and said completion date is <br /> not fulfilled, the Council may stipulate additional conditions <br /> to protect the surrounding area from adverse effects . Failure <br /> to meet stipulated conditions set forth by the Council shall re- <br /> sult in a Stop Work Order or cancellation of the Special Property <br /> Use Permit. <br /> Special Property Use Permit applications shall be accompanied by <br /> a complete plan of the proposed use and adequate information to <br /> fully inform the Planning Commission of the applicants intention <br /> and proposal. <br /> Special Property Use Permits are non-tranferrable and all inter- <br /> ested parties shall be named as co-applicants . <br /> 1. Airfields , air parks , land fields , and helio-ports . <br /> 2 . Cemetaries , mausoleums , and crematoriums . <br /> 3. Juvenile Institutions , when ten or more children are <br /> provided for. <br /> 4. Churches ; also including group dwellings for members <br /> of religious order in conjunction with permitted <br /> churches . <br />
