ORDINANCE NO. 96- 74 AN ORDINANCE amending Everett City Code Sections 15 .04 .070 (Ordinance No. 3572 , Section 5) and 15 .05. 190 (Ordinance No. 3572 , Section 17) , dealing with zoning, special property use , and off-street parking and loading requirements . WHEREAS , the Planning Commission of the City of Everett held public hearings on the 21st day of July , 1970 , and made recom- mendations to the City Council proposing certain changes in the Zoning Ordinance , and WHEREAS, the City Council of the City of Everett approve said recommendations , NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: SECTION 1: That Everett City Code , Section 15 .04.070 (Ordinance No. 3572 , Section 5) is hereby amended to read as follows : "15 .04. 070 GENERAL PROVISIONS-SPECIAL PROPERTY USE The following uses , because of the large land area associated with their needs and the importance of their location to the Comprehensive Plan or to public convenience and necessity, shall be considered only after a public hearing held by the Planning Commission. The Planning Commission before recommend- ing to the City Council either for or against the proposed use shall determine whether or not the proposed use is detrimental to the General Comprehensive Plan, adjacent and surrounding properties , the ecology and/or environment of the Community. If the proposed use is recommended by the Planning Commission and approved by the City Council , the Planning Director shall sign the Special Property Use Permit and shall stipulate off- street parking requirements and set-back distances . Any other reasonable conditions may be stipulated by the Planning Commis- sion and/or the City Council including but not limited to green- belts , sight obscuring screening, access controls , and similar siting factors . The Planning Commission may recommend and the City Council may stipulate a time limit for initiation and/or completion of the project. If a substantial start has not been made within the initiation time limit , the City Council may declare the Spe- cial Property Use Permit null and void. If a completion time limit is stipulated by the Council and said completion date is not fulfilled, the Council may stipulate additional conditions to protect the surrounding area from adverse effects . Failure to meet stipulated conditions set forth by the Council shall re- sult in a Stop Work Order or cancellation of the Special Property Use Permit. Special Property Use Permit applications shall be accompanied by a complete plan of the proposed use and adequate information to fully inform the Planning Commission of the applicants intention and proposal. Special Property Use Permits are non-tranferrable and all inter- ested parties shall be named as co-applicants . 1. Airfields , air parks , land fields , and helio-ports . 2 . Cemetaries , mausoleums , and crematoriums . 3. Juvenile Institutions , when ten or more children are provided for. 4. Churches ; also including group dwellings for members of religious order in conjunction with permitted churches .
