• p • • That said improvement has alr.eady been deemed necessary for the public safety, necessity, and convenience and that said improvement must be established over, across, upon, and beneath certain property and land as hereafter described: Parcel before taking: The North 71. 07 feet of the East 110 feet of Lot 1, Beverly Acreage Tracts, except the North 30 feet thereof conveyed for road (41. 07 x 110 feet on the S. W. corner of Beverly Lane and Madison). Taking: Beginning at the Southerly right-of-way of Madison Street and the East 110 feet of Lot 1, Plat of Beverly Acreage Tracts, according to the plat thereof, recorded in Volume 10 of Plats, page 50, records of Snohomish County, Washington; thence Southerly along the Westerly line of said East 110 feet of Lot 1, a distance of 6. 0 feet; thence Easterly parallel with the North line of said Lot 1, a distance of 79. 77 feet; thence on a curve to the right having a radius of 20. 0 feet and a central angle of 90°40'02" an arc distance of 21. 92 feet; thence Southerly parallel with the Easterly line of said Lot 1 to the Southerly line of the Northerly 71. 07 feet; thence Easterly along the Southerly line of the Northerly 71. 07 feet of said Lot 1, a distance of 10. 0 feet to the Easterly line of said Lot 1; thence Northerly along the Easterly line of said Lot 1 7 feet to the Southerly right-of-way line of Madison Avenue; thence Westerly along the Southerly right-of-way line of Madison Street to the point of beginning. That the interest sought in the above described parcel is a fee necessary to the heretofore described improvements. Section 2: All land rights and privileges sought within the limits of the above described parcel are hereby condemned, appropriated, taken, and damaged for public use and necessity for street, drive or boulevard purposes; and all such lands, rights and privileges are to be taken, damaged and appropriated only after just compensation has been made or paid in the court for the owners thereof in the manner provided by law. Section 3: The entire cost of the improvement provided for herein shall be paid from the proceeds of the unlimited tax levy general obligation bond issue in the principle amount of $9, 500, 000 authorized by the qualified electors of the City of Everett on February 7, 1967. Section 4 : The City Attorney is hereby authorized and directed to begin and prosecute the proceedings provided by law to condemn, take, appropriate and damage the land, rights, privileges necessary to carry out the provisions of this ordinance.
