Section 7: Variance <br /> A Board of Appeal is hereby created to hear requests for special <br /> exceptions and variances from any provision of this ordinance or any <br /> determination of the Building Inspector in the application of the provisions <br /> of this ordinance to the appellant's land and/or structure. The Board shall <br /> consist of those members of the Board of Adjustment appointed by the Mayor <br /> under the provisions of Section 15. 04. 320, Everett City Code, Ordinance <br /> No. 3572. The appeal procedure and the Board's decision will be governed <br /> by the procedures and standards set out in the City Zoning Code, Sections <br /> 15. 04. 330 through 15. 04. 420, Everett City Code, Ordinance No. 3572. <br /> In respect to variances for roof signs the Board will also consider <br /> such factors as height above the roof, obstruction of view from another <br /> building, appearance of the structure including bracing and its proportions <br /> to the building on which it is placed. When considering variances in <br /> respect to size, the Board will also consider such factors as the proportion <br /> of the sign to its surroundings, appearance of the structure, including <br /> bracing, obstruction of view from another building, and adequate access to <br /> light and air. <br /> Section 8. Removal of billboards. <br /> The city shall order the removal of any billboard erected or maintained <br /> in violation of this ordinance. Ten (10) days notice in writing shall be given <br /> to the owner of such billboard or the owner of the premises on which such <br /> billboard is located, to remove the billboard or to bring it into compliance <br /> with the ordinance. Upon failure to remove the billboard or to comply <br /> with this notice, the city shall remove the billboard. The city shall remove <br /> the billboard immediately and 'without notice if it reasonably appears that <br /> the condition of the billboard or supporting structure is such as to present <br /> an immediate threat to the safety of the public. Any cost of removal incurred <br /> by the city shall be assessed to the owner of the property on which the billboard <br /> is located and may be collected in the manner of ordinary debt or in the manner <br /> of taxes and said charge shall be a lien on the property. <br /> Page 4 <br />
