• <br /> tenants thereof are not billed for any public utility <br /> services furnished by the City to such unit or units, <br /> the person who is billed for such service or services <br /> shall be deemed to be served and billed therefor, and <br /> shall be billed and pay the monthly excise tax as herein <br /> levied and provided for on each and every such commercial <br /> unit or units; provided, however, such amount so billed <br /> and collected shall not exceed 90% of the total excise <br /> tax as above provided for and levied for such housing unit <br /> or units, which is the average percentage of occupancy in <br /> commercial units within the City of Everett. <br /> C. On each person having employees the sum of $0. 20 per <br /> employee per month; provided, however, that the total sum <br /> payable by each person having employees shall not exceed <br /> $2, 500. 00 per month. <br /> In the event that any person shall be subjected to more than one levy of <br /> the excise tax under the definitions and provisions hereinabove set forth <br /> in this section, such person shall be liable for only one excise tax levy, <br /> which shall be the highest tax levy for which he could be held liable. <br /> The excise taxes here in this chapter levied shall be separately designated <br /> and identified on each taxpayer's regular City utility billing as a tax to be <br /> used solely for the operation, maintenance, and capital needs of the Everett <br /> Transit System, and shall be otherwise billed, collected and accounted for <br /> substantially at the same time and in the same manner as services for other <br /> City public utilities, including the right of civil suit for the collection thereof as <br /> a debt. <br /> All proceeds from such transit subsidy excise taxes and all revenues <br /> from the transit system shall be forthwith paid into a fund hereby established <br /> and designated as the "Transit Fund. " Money so received and deposited in said <br /> fund shall be used only for the operation, maintenance and capital needs of <br /> public transportation for the City of Everett. If the City shall cease operation <br /> of a transit system, the tax herein imposed shall be deemed rescinded as soon <br /> as all transit obligations have been met. In addition to the right of civil <br /> suit for collection of debt, it shall be unlawful for any person served by and <br /> billed for any water system to refuse to pay the transit subsidy excise taxes <br /> herein required. Any person who violates the provisions of this section shall <br /> be guilty of a misdemeanor, and, upon conviction thereof, shall be punished by <br /> a fine of not to exceed $300. 00. <br /> Section 3. If any section or part of any section of this ordinance shall <br /> be declared invalid for any reason by any court, such invalidity shall not affect <br /> Page 3 <br />
