• ORDINANCE NO. 36 `6 AN ORDINANCE amending the water regulations for the City of Everett to authorize enforcement of Latecomers' Agreement and amending Ordinance No. 4085, Section 4 (E.C.C. 14.16.040) ; Section 12 (E.C.C. 14.16.130; and Section 87 (E.C.C. 14.16.860) . NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That Everett City Code Section 14.16.040 (Ordinance No. 4085, Section 4) is hereby amended in full to read hereafter as follows : 14.16.0.40 Superintendent' s qualifications and appointment. The superintendent of the water department shall be a licensed civil engineer of the state of Washington and shall be experienced in the management and operation of water systems and shall have in his charge and under his control, subject to the mayor, the management, maintenance and operation of the water department, including all existing and future plant facilities, land and rights, both tangible and intangible, and of all equipment and persons employed thereon and of all planning and construction work undertaken by the water department in connection with the water system. The superintendent shall be appointed by the mayor and his appointment shall be subject to confirmation by the city council. Section 2 : That Everett City Code Section 14.16.130 (Ordinance No. 4085, Section 12) is hereby amended in full to read hereafter as follows : 14.16.130 Service connection charges. The initial service connection installation cost for customers within the city limits for a fixed rate service, a three-fourths inch, a one inch and a two inch metered service shall be as set forth in Section 14.16.720 plus any charge applicable to the property or the connection as a consequence of any latecomer agreement by which the City is obligated to collect latecomer charges on behalf of previously connected customers who have privately paid for distribution system improvements, renewals or extensions as provided in E.C.C. 14.16 .050. Latercomer charges shall not apply to system improve- ments by L.I.D. Metered service connections within the city limits which are larger than two inches in diameter and all metered service connections outside the city limits shall be installed at the actual cost of making the installation.
