WITNESSETH <br /> WHEREAS, the undersigned Grantor, HopeWorks Social Enterprises, a Washington <br /> nonprofit corporation (in its capacity as owner of Unit 1 of HopeWorks Station II <br /> Building, a Condominium), is the owner the real property legally described in Exhibit A <br /> attached hereto ("Property"); and <br /> WHEREAS, Grantor intends to convey the Property to HopeWorks Station Enterprises, <br /> a Washington nonprofit corporation; and <br /> WHEREAS, HopeWorks Social Enterprises, a Washington nonprofit corporation, <br /> hereinafter referred to as "Applicant," is the owner of a property located directly south of <br /> the Property, located at 3331 Broadway, which is within 300 feet of the Property. The <br /> building at 3331 Broadway is located on the following real property, legally described <br /> as: Unit 1 of HopeWorks Station Master, a Condominium, according to <br /> Declaration thereof recorded under Recording No. 201804060118 and <br /> amendment(s) thereto; said Unit is located on Survey Map and Plans recorded <br /> under Recording No. 201804065001, Records of Snohomish County, Washington; <br /> and <br /> WHEREAS, the Applicant has proposed providing 35 parking stalls to meet the required <br /> amount of off-street parking for uses in the building of 3331 Broadway, in a parking <br /> facility benefitting the Property; and <br /> WHEREAS, the Grantee, the City of Everett ("City"), has a substantial interest in the <br /> effective and safe use of lands within its borders, and in the health, safety and welfare <br /> of its citizens; and <br /> WHEREAS, the City has an interest in ensuring safe travel along City streets and in <br /> minimizing traffic congestion that may be associated with inadequate provision for <br /> parking by property owners; and <br /> WHEREAS, before the City will issue the land use approval, pursuant to EMC <br /> 19.34.060(D), the Grantor, as owner of the Property where the parking will be located, <br /> shall execute a covenant in a form acceptable to the City Attorney; and <br /> WHEREAS, this Covenant must state that the Property on which the parking will be <br /> located is devoted in whole, or in part, to parking that serves the use on Applicant's <br /> property, and this Covenant must be signed, acknowledged and recorded in the records <br /> of Snohomish County as a restrictive covenant, restricting the use and enjoyment of the <br /> Property by placing such a condition on the land use approval; and <br /> WHEREAS, this Covenant concerns the Grantor's use, occupation, enjoyment of the <br /> Property and benefits the City, as Grantee; and <br />
