• WHEREAS, this Covenant is intended to bind successors and assigns and run with the land; NOW, THEREFORE, Grantor agrees to abide by restrictions on occupation, use, and enjoyment of the Property as follows: 1. Grantor agrees that the Property is devoted in whole, or in part, to parking that serves the use on Applicant's property, providing 35 parking spaces so as to enable Applicant to meet Applicant's parking requirements pursuant to the Zoning Code. 2. Grantor agrees to devote the following portion of lands, legally described below as the "Parking Portion", to parking that serves the use on Applicant's lot: Those parking spaces numbered 1 to 3 (inclusive), 15 to 29 (inclusive), and 36 to 39 (inclusive) designated as Limited Common Elements and allocated solely to the Property and the Limited Common Element parking lot labeled "South Parking Lot" and allocated solely to the Property, all according to Declaration of HopeWorks Station II Building, a Condominium, recorded under Recording Number I(600421-0 IVA and amendment(s) thereto, said parking spaces are located on Survey Map and Plans recorded under Recording Number 2Vibti-t1WXD, Records of Snohomish County, Washington. 3. This document shall constitute a covenant running with the land and the rights and obligations of the parties hereto shall inure to the benefit of and be binding upon their respective legal representatives, successors and assigns. 4. This Covenant shall terminate in the event that 1) the use on the Applicant's property that created the need for the off-site parking on the Parking Portion of Grantor's Property is abandoned or discontinued; or 2) the Applicant provides parking in an alternate location acceptable to and approved by the City.
