The Owner shall require that Project construction contractors and <br /> subcontractors pay their laborers and mechanics at wage rates not less than <br /> those prevailing on similar construction in the locality in accordance with <br /> Chapter 39.12 RCW pertaining to payment of state prevailing wages on public <br /> works projects. <br /> C. Professional Services <br /> The Owner shall use the services of a professional architect or engineer to <br /> perform Project design and contract administration. The professional engineer <br /> or architect shall be licensed in the State of Washington to perform such <br /> services and shall possess errors and omissions insurance covering its <br /> performance of such services. <br /> D. Project Schedule <br /> The obligation of the Owner to construct and/or acquire or cause the <br /> construction and/or acquisition of the Project in the manner required by this <br /> Section XIII and in the time required by Exhibit F (the "Project Schedule"), <br /> attached hereto and by this reference incorporated herein. If, in the reasonable <br /> opinion of the City, the Owner fails to meet or cause to be met the Project <br /> Schedule or Construction standards referred to herein, the City shall be entitled <br /> to exercise any or all of its remedies for breach pursuant to Section XVIII of this <br /> Agreement. <br /> XIV. ENVIRONMENTAL REVIEW <br /> The Owner retains responsibility for fulfilling the requirements of the State <br /> Environmental Policy Act (SEPA) and regulations and ordinances adopted <br /> thereunder. <br /> XV. COMPETITIVE BIDDING <br /> The Owner shall make every reasonable and practicable effort to utilize or cause to <br /> be utilized a competitive bidding process. <br /> XVI. REPORTING REQUIREMENTS; ANNUAL REPORTS <br /> Once the Project has been completed, the Owner shall, for the term of the <br /> Agreement, submit to the City upon request program participant information, which <br /> may include, but is not limited to, income, , race, disability status, number of <br /> persons turned away, etc. <br /> XVII. AUDITS; INSPECTIONS <br /> The Owner agrees that it and the Project are subject to audit by the City and to <br /> recovery for any audit exception which occurs due to its negligence or failure to <br /> comply with the terms of this Agreement. <br /> At any time during the term of this Agreement, the City or its designee may enter <br /> and inspect the physical premises of the Owner's office and inspect all accounting <br /> 9 <br />
