• <br /> Section 12. Bulkhead, <br /> All bulkhead buildings and substructures hereinafter constructed <br /> shall conform to the req-airement=, for piers and wharves as provided for <br /> in this standard. When bulkhead buildings are within 30 feet of other structures <br /> a dividing wall shall be provided of construction of not less than four-hour fire <br /> resistance rating and standard protection shall be provided for all exposed door <br /> and window openings. When such buildings immediately join other structures <br /> they shall be separated by walls of four-hour fire resistance rating with open- <br /> ings protected by double fire doors. Fire doors and windows shall be installed <br /> in accordance vrlth the Standard for the installation 01 Fire Doors and Windows. <br /> (NFPA No. 80, 1968) . <br /> Section I3. � ppeals. <br /> A. A Board of appeals is hereby established consisting of five members <br /> to serve without salary. Board members shall be appointed by the <br /> Mayor with approval of Council and shall consist of citizens having an <br /> understanding of the benefits of fire prevention and of piers and docks <br /> - construction. Members of the Board shall be appointed, or reappointed, <br /> annually. <br /> B. Any person or persons aggrieved by the interpretation or application <br /> of this ordinance, or any determination of the Chief of Everett Fire <br /> • Department in the spplics.tion or interpretation of this ordinance, may <br /> request review by the Board. The Board may affirm, reverse, or <br /> condition the interpretations or applications of the provisions of this <br /> ordinance as made by the Chief of the Fire Department in any order, <br /> requirement, decision or determination relating thereto. <br /> C. The Board may authorize variances La specific cases from the <br /> provisions or requirements of this ordinance as will not be contrary <br /> to the public interests but only where, owing to special conditions <br /> pertaining to a specific piece•of property, the literal enforcement of <br /> the provisions or requirements of this ordinance would cause undue <br /> and unnecessary hardship, other than direct economic hardship. No <br /> such variance in the provisions or requirements of this title shall be <br /> authorized unless the Board specifically finds that the following criteria <br /> exist: <br /> I. Exceptional or extraordinary circumstances or conditions <br /> applying to the subject property or structure that do not apply <br /> generally to other properties or structures in the same vicinity. <br /> IL The authorization of such variance will not be materially <br /> detrimental to the public welfare or injurious to other property <br /> and the vicinity or zone in which the property is located. <br /> The Board shall make specific findings of facts and conditions <br /> which establish the above criteria. The Board may attach to the <br /> variance such conditions as it may deem necessary to carry out the <br /> spirit and purposes of this ordinance and in the public Interests. <br /> • <br /> Ordinance -13- <br /> . <br />
