• Section 12. Bulkhead, All bulkhead buildings and substructures hereinafter constructed shall conform to the req-airement=, for piers and wharves as provided for in this standard. When bulkhead buildings are within 30 feet of other structures a dividing wall shall be provided of construction of not less than four-hour fire resistance rating and standard protection shall be provided for all exposed door and window openings. When such buildings immediately join other structures they shall be separated by walls of four-hour fire resistance rating with open- ings protected by double fire doors. Fire doors and windows shall be installed in accordance vrlth the Standard for the installation 01 Fire Doors and Windows. (NFPA No. 80, 1968) . Section I3. � ppeals. A. A Board of appeals is hereby established consisting of five members to serve without salary. Board members shall be appointed by the Mayor with approval of Council and shall consist of citizens having an understanding of the benefits of fire prevention and of piers and docks - construction. Members of the Board shall be appointed, or reappointed, annually. B. Any person or persons aggrieved by the interpretation or application of this ordinance, or any determination of the Chief of Everett Fire • Department in the spplics.tion or interpretation of this ordinance, may request review by the Board. The Board may affirm, reverse, or condition the interpretations or applications of the provisions of this ordinance as made by the Chief of the Fire Department in any order, requirement, decision or determination relating thereto. C. The Board may authorize variances La specific cases from the provisions or requirements of this ordinance as will not be contrary to the public interests but only where, owing to special conditions pertaining to a specific piece•of property, the literal enforcement of the provisions or requirements of this ordinance would cause undue and unnecessary hardship, other than direct economic hardship. No such variance in the provisions or requirements of this title shall be authorized unless the Board specifically finds that the following criteria exist: I. Exceptional or extraordinary circumstances or conditions applying to the subject property or structure that do not apply generally to other properties or structures in the same vicinity. IL The authorization of such variance will not be materially detrimental to the public welfare or injurious to other property and the vicinity or zone in which the property is located. The Board shall make specific findings of facts and conditions which establish the above criteria. The Board may attach to the variance such conditions as it may deem necessary to carry out the spirit and purposes of this ordinance and in the public Interests. • Ordinance -13- .
