The restoration plan is approved, subject to the following: 1. Wetland restoration shall be performed by removing fill,grading and planting of native wetland plants in accordance with the Critical Areas Study and Mitigation Plan dated October 30, 2017 (mitigation plan). 2. Following the removal of fill within the wetland/buffer areas,the on-site soils must be evaluated for their suitability to support native wetland and buffer plants. If necessary, additional topsoil must be provided as set forth in the mitigation plan. 3. The interim stream and wetland buffer on the north and east sides of the stream shall be a minimum of 30 feet at this time. This area shall be planted with native vegetation per the planting schedule provided in the restoration plan. This shall be an interim buffer necessary to prevent erosion, sedimentation and water quality problems within the stream and wetland areas. A permanent buffer will be established at such time as a formal land use application is submitted and approved for the property. It is noted that a reasonable use application will be the appropriate application process, since the standard wetland and stream buffers would most likely render the property undevelopable (see Option 3 graphic exhibit in the mitigation plan). 4. Fencing—A construction fence or other temporary fence shall be installed along the edge of the 30' buffer. 5. Removal of Vehicles from site. Please note the temporary use permit to allow truck parking on the site has expired and the trucks must be removed from the site. 6. Public Works Permit—Per the Violations Hearing Examiner Order dated 8/31/17, an application for Public Work permit shall be submitted no later than November 28,2017. Please contact the Public Works/Permit Services Department at 425-257-8810 for more information on submittal requirements. 7. Performance Bond—A performance bond in the amount of 300%of the value of restoration work (materials and labor) at the time of Public Works permit issuance. 8. Timing of Restoration Work-The City will not impose seasonable limitations on restoration work since the project involves correcting a violation and will reduce water quality impacts on Swamp Creek.
