<br /> AN ORDINANCE relating to, regulating and licensing coin operated amusement devices
<br /> and machines, fixing license fees; defining offenses; prescribing penalties, and
<br /> repealing Everett City Code 3.52.100 and declaring an emergency to exist.
<br /> BE IT ORDAINED BY THE CITY OF EVERETT AS FOLLOWS:
<br /> Section . AMUSEMENT ARCADE shall mean a place where twenty (20) or more coin
<br /> operated amusement devices are exhibited for play and where vending machines, weight
<br /> lifting devices, shuffleboards, scales, punching bags, mechanical music machines,
<br /> amusement rides, shooting galleries, or similar devices are exhibited or exposed for
<br /> play or use by the public.
<br /> AMUSEMENT DEVICE shall mean any machine or device designed to be operated or used
<br /> for playing a game upon the insertion of a coin, trade check or slug, as hereinafter
<br /> provided, and which is played or operated only for amusement and entertainment,
<br /> and will include the following: Shuffleboards, mechanical music machines, pool
<br /> tables, flipper games, baseball machine, bowling games, guns and rifles, riding
<br /> devices for not more than two persons, panorama or peep show, or other game, operated
<br /> by inserting a coin, or operated by remote control or with a timing device, but
<br /> shall not mean or include any machine or device used exclusively for the vending
<br /> of merchandise:
<br /> OPERATOR shall mean any person who owns and exhibits for use, play or operation and
<br /> who leases or rents to or places with others any amusement device for use, play,
<br /> or operation;
<br /> PERSON shall mean and include an individual, corporation, co-partnership or
<br /> association;
<br /> WHOLESALE DISTRIBUTOR shall mean any person who engages in the business of selling,
<br /> exchanging, or offering or exhibiting for sale or exchange, any amusement device.
<br /> Section 2 . AMUSEMENT ARCADE LICENSE: It shall be unlawful to operate or conduct,
<br /> own, or be employed in, an Amusement Arcade unless a valid "Amusement Arcade License"
<br /> has been procured for, and is conspicuously displayed in, each such Amusement Arcade.
<br /> No such Amusement Arcade License shall be issued except to a citizen of the United
<br /> States who has been a resident of the City of Everett for at lease five (5) years
<br /> next prior to filing application therefor. Not more than one such license shall
<br /> be issued for each 50,000 of the total population of the City, as shown by the last
<br /> preceding State or Federal Census, provided, that nothing contained in this section
<br /> relating to residence, citizenship, or per capita limitation. of licenses shall apply
<br /> to any person now holding a valid Amusement Arcade License.
<br /> Section 3 . LOCATION AMUSEMENT DEVICE LICENSE: It shall be unlawful for any person
<br /> to display, exhibit or expose or permit to be displayed, exhibited or exposed for
<br /> purpose of use, play or operation, or permit to be used, played or operated, for
<br /> profit, any amusement device without having a valid and subsisting license, to be
<br /> designated as "Location Amusement Device License." A separate location license is
<br /> required for each place of business; and shall at all times be conspicuously posted
<br /> and maintained in each place of business. The City Clerk-Comptroller shall prescribe
<br /> the form of location license, shall designate a number therefor, and shall indicate
<br /> thereon the number of such devices which may be exhibited, exposed, used or played
<br /> thereunder.
<br /> Section 4 . OPERATOR'S MASTER LICENSE: It shall be unlawful for anyone to be or
<br /> become an operator without having a valid and subsisting license, to be designated as
