EVERETT <br /> WASHINGTON <br /> ORDINANCE NO. 3692-19 <br /> An Ordinance Relating to Interference with a Health Care Facility, amending Ordinance No. 1145-85, as <br /> previously amended. <br /> WHEREAS, <br /> A. The crime Interference with a Health Care Facility is a gross misdemeanor crime codified under <br /> State law as RCW 9A.50.020 and RCW 9A.50.030. This crime has not yet been incorporated into <br /> the Everett Municipal Code. <br /> B. The City of Everett is home to numerous health care facilities. It is vitally important to public <br /> health and safety that such facilities be permitted to carry out their health care tasks without the <br /> disruption of criminals violating the Interference with a Health Care Facility law. Incorporating <br /> RCW 9A.50.020 and RCW 9A.50.030 into the Everett Municipal Code will permit the City to <br /> prosecute this criminal conduct. <br /> C. The City of Everett has the power to provide for the punishment of all practices dangerous to <br /> public health or safety, and to make necessary for the preservation of public health, peace and <br /> good order and to provide for the punishment of all persons charged with violating any city <br /> ordinances. <br /> D. The Everett City Council deems it appropriate for the City of Everett criminal laws to incorporate <br /> corresponding State law, that the City of Everett may prosecute such crimes. <br /> NOW,THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Ordinance No. 1145-85 is amended by the addition of the following section which will be <br /> codified as EMC 10.68.070: <br /> Interference with health care facility. <br /> A. It is unlawful for a person except as otherwise protected by state or federal law, alone or in concert <br /> with others, to willfully or recklessly interfere with access to or from a health care facility or willfully <br /> or recklessly disrupt the normal functioning of such facility by: <br /> 1. Physically obstructing or impeding the free passage of a person seeking to enter or depart from <br /> the facility or from the common areas of the real property upon which the facility is located; <br /> 2. Making noise that unreasonably disturbs the peace within the facility; <br />
