3. Trespassing on the facility or the common areas of the real property upon which the facility is <br /> located; <br /> 4. Telephoning the facility repeatedly, or knowingly permitting any telephone under his or her <br /> control to be used for such purpose; or <br /> 5. Threatening to inflict injury on the owners, agents, patients, employees, or property of the facility <br /> or knowingly permitting any telephone under his or her control to be used for such purpose. <br /> B. Penalty: A violation of EMC 10.68.070.A is a gross misdemeanor. A person convicted of violating EMC <br /> 10.68.070.A shall be punished as follows <br /> 1. For a first offense, a fine of not less than two hundred fifty dollars and a jail term of not less than <br /> twenty-four consecutive hours; <br /> 2. For a second offense, a fine of not less than five hundred dollars and a jail term of not less than <br /> seven consecutive days; and <br /> 3. For a third or subsequent offense, a fine of not less than one thousand dollars and a jail term of <br /> not less than thirty consecutive days. <br /> C. Definitions. <br /> 1. "Health care facility" means a facility that provides health care services directly to patients, <br /> including but not limited to, a hospital, clinic, health care provider's office, health maintenance <br /> organization, diagnostic or treatment center, neuropsychiatric or mental health facility, hospice, or <br /> nursing home. <br /> 2. "Health care provider" has the same meaning as defined in RCW 7.70.020 (1) and (2), and also <br /> means an officer, director, employee, or agent of a health care facility who sues or testifies <br /> regarding matters within the scope of his or her employment. <br /> Section 2. The City Clerk and the codifiers of this Ordinance are authorized to make necessary <br /> corrections to this Ordinance including, but not limited to, the correction of scrivener's/clerical errors, <br /> references, ordinance numbering, section/subsection numbers, and any internal references. <br /> Section 3. The City Council hereby declares that should any section, paragraph, sentence, clause or <br /> phrase of this ordinance be declared invalid for any reason, it is the intent of the City Council that it <br /> would have passed all portions of this ordinance independent of the elimination of any such portion as <br /> may be declared invalid. <br /> Section 4. The enactment of this Ordinance shall not affect any case, proceeding, appeal or other <br /> matter currently pending in any court or in any way modify any right or liability, civil or criminal, which <br /> may be in existence on the effective date of this Ordinance. <br /> 2019 ORDINANCE: Interference with a Health Care <br /> 111 Faciliity Page 2 of 3 <br />
