ORDINANCE NO. 4008. AN ORDINANCE AMENDING CERTAIN SECTIONS OF CHAPTER 3 .52 EVERETT CITY CODE , PRESCRIBING THE TYPE OF LICENSES TO BE ISSUED, THE FORM OF APPLICATION AND CASH BOND FOR ANY EXHIBITION , PERFORMANCE , SHOW , ENTERTAINMENT , AMUSEMENT OR BUSINESS OF THE TYPE OF A CIRCUS, CARNIVAL , SKATING RINK, MINATURE GOLF COURSE , AND AUTOMATIC AMUSEMENT GAME AND REQUIRING PERSONS AND CORPORATIONS CONDUCTING SUCH FORM OR TYPE OF ENTER- TAINMENT OR AMUSEMENT OR BUSINESS TO OBTAIN A LICENSE FROM THE CLERK, FIXING FEES THEREFOR, AMENDING EVERETT CITY CODE 3 .52.020 AND 3 .52.030 AND REPEALING SECTIONS 3 .52.040 3 .52 .050, AND 3 .52.070 , AND DECLARING AN EMERGENCY TO EXIST . NOW THEREFORE , THE CITY OF EVERETT DOES ORDAIN: Section 1 : That Section 3 .52.020, Everett City Code, is amended to read as follows, to-wit: 3.52.020: Licenses - Applicant - Cash Bond - City Clerk to Issue. Licenses for any such exhibition , performance, show, entertainment , amusement or business shall be issued by the City Clerk upon application by the owner or operator of such exhibition, performance, show, entertainment or amusement or business and shall be, by the City Clerk, delivered to the City Treasurer who shall collect the amount of the license fee fixed by the ordinance to be paid for such license, and return the application showing the payment of such fee to the City Clerk who shall thereupon deliver such license to the applicant upon receiving from the applicant a cash deposit in the sum of TWO HUNDRED AND FIFTY ($250.00) DOLLARS , and an undertaking that the applicant is the owner or operator of such exhibition, performance, show, entertainment , amusement or business and that such applicant will comply with the laws of the City of Everett and the State of Washington in the course of presenting his said show and will pay to the City of Everett any and all applicable excise taxes of the City of Everett as provided in Everett City Code Title 4, such under- taking to be in such form as may be approved by the City Clerk or the City Attorney, and such undertaking to provide for the return of such cash deposit upon fulfillment by the applicant of the conditions of said undertaking as herein provided by this section . Section 2: That Everett City Code Section 3 .52.030 is amended to read as follows , to-wit: 3 .52.030. Circus and carnival type shows - license fees - how computed. For each and every of the following type shows or exhibitions within the City of Everett , and for each and every person or corporation operating amusement devices within the City of Everett , there shall be paid a license fee as follows:
