AN ORDINANCE relating to public health, safety and welfare and regulating the manner of exterminating and ground spraying ''0` in the control of rodents, weeds , insects , fungi , snails or slugs , and other such animals and vegetation and providing regulations for the keeping and use of certain dangerous substances therefor ; requiring licenses and certificates ; describing offences and prescribing penalties therefor ; and declaring an emergency to exist . NOW , THEREFORE , THE CITY OF EVERETT DOES ORDAIN : Section] : Definitions: Unless the context otherwise requires , the definitions set forth in the Washington Pesticide Act , Chpater 2L: ; , Section 2 , laws of 12111 ( C.'W. 17 . 4:1 .020 ) shall be applicable under this Chapter and seal l be used in construing ani enforcing this ordinance . In addition to the definitions of terr::s set forth in said Washington Pesticide Act , the following definitions shall also apply , to-wit : "Extermination or exterminate" means the use of powders , s,,-,rays , or baits for the destruction of rt)dt'nt° , vermin , lung i , insects or other pests . "Exterminator" means a person who for hire engages in the actual work of applying powders , sprays , or baits for the destruction of rodents , vermin , fun i , Insects or other "Ground sprayer" means any person engaged in the application of pesticides upon lands or crops of another , and who uses a sprayer or applicator which is controlled h a source of power not the operator . Section 2 : No person shall engage in the business of a ground sprayer or applicator of pesticides within the City of Everett , unless and until he has furnished proof of compliance with the Washington Pesticide Act ( .0 .W. Chapter 1 7 . < 1 ) and produced for inspection by the City Clerk or his deputies , a pesticide applicator ' s license as provided in said State code . Further, no person shall apply a pesticide or engage in the application of a pesticide to the land of another by ground spraying as an operator of a ground sprayer unit unless such operator has complied with the Washington Pesticide Act (�..C .W. 17 . 2.1 ) and furnishes proof thereof satisfactory to the Everett City Clerk . Section 3 : Exterminators . No person shall engage in the business of exterminating or extermination or hold himself out as an exterminator unless he has first made application to the City Clerk of the city of Everett for a license to so conduct such business . The applicant shall make application upon such forms as provided by the office of the City Clerk and such application shall contain the name of the individual or cor- poration operating as an exterminator ; the business address of such individual applicant , together with the principal business address in the State of Washington , if elsewhere; the name of the person whose domicile is in the State of Washington who is authorized to receive and accept services of summons and legal notices of all kinds for the applicant ; the place and the manner - 1 -
