<br /> 3 AN ORDINANCE granting to the Alderwood Water District, a
<br /> 4 Municipal Corporation, a franchise to install, operate, maintain,
<br /> repair and replace a water line, including all necessary appurtenances,
<br /> 5 under and along certain designated streets in the City of F3V,' .

<br /> 7 NOW THEREFORE the City of Everett does ordain;
<br /> 8 Section 1. That there be and is hereby granted upon the con-
<br /> siderations and conditions in this ordinance contained, to the Alder-
<br /> s wood Water District, a municipal corporation of the State of Washington,
<br /> its successors and assigns, for a period of twenty-five years from
<br /> 10 and after the effective date of this ordinance, the right, privilege
<br /> and authority to construct, install, maintain, operate, repair and
<br /> 11 replace, a water line, including all necessary appurtenances under
<br /> and along the following streets, alleys and public highways of the
<br /> 12 City of Everett for the purpose of transmission of water :
<br /> 13 Beginning at a point on the north boundary of Berkshire Drive,
<br /> 14 which point lies 30 ft. westerly of the northwest corner of
<br /> Lot 11, Blk 2, Beverly Hills Division No. 2, and which
<br /> 15 point is also on the south boundary of that certain tract
<br /> known as City of Everett Reservoir No. 3 site (recorded
<br /> 16 June 7, 1923 in Book 129 of Deeds, Page 511) ; thence
<br /> southerly in Berkshire Drive to Madison Avenue, thence
<br /> 17 easterly in Madison Avenue to Olympic Drive, thence south-
<br /> erly crossing Madis n Avenue to the south City limits of
<br /> 18 Everett, all in Snohomish County, Washington
<br /> 19 Section 2. The Grantee by its acceptance of this ordinance and
<br /> 20 franchise rights, privileges and authority hereby granted for itself,
<br /> its successors and assigns, covenants and agrees to and with the City at
<br /> 21 all times to protect and save harmless the said City from all claims,
<br /> actions, suits, liability, loss, cost, and expense or damage of every
<br /> 22 kind and description which may accrue to or be suffered by any per-
<br /> sons or person by reason of the construction, operation, maintenance,
<br /> 23 repair and replacement and operation of a water line and appurtenances
<br /> under and along certain streets of the City of Everett, and in case
<br /> 24 suit or action shall be instituted or begun against the City for
<br /> damages arising by reason thereof, further covenants and agrees upon
<br /> 25 notice to it, of commencement of said action or suit, to defend the same
<br /> at the sole expense and cost of said Grantee, its successors or assigns; ;
