• ORDINANCE No. 3016 . AN IXDIN'y-CE providing for the improvement of `mall Street from Rockefeller Avenue to Oakes Avenue by grading to proper grade, construction of Portland cement concrete pavement or by the construction of Bituminous pavement with curbs and gutters, installation of necessary drainage and doing all work necessary t make a complete improvement ; erecting an es3essrnent district ; creating a local improvement fund therefor; providing that the pa - ment of said improvement be made by special assessment on the property in said district under the mode of payment by bonds; and WHEREAS „, there has heretofore been filed with the City Council of the City of Everett a majority petition of the property owners petitioning for said improvement , and upon examination thereof the said City council has found the things therein set forth to be true; and WHEREAS the original petition filed herein asked that bids be called on both types of pavement and after said bids are re- ceived the City Council of the City of Everett will decide on the type of improvement to be made; and WHEREAS the said petition has been referred to the Commissioner of Public works to be examined by the said Commissioner and the City Engineer, and the Commissioner of Public Works has filed with the City Council all date and information required by law; and 7EREAS said Commissioner of Public Works has recommended to the City Council that said improvement petitioned for be made, and it appearing to the City Council that the public health, convenience and necessity require that such improvement be made. NOW, THEREFORE, the CITY OF EVERETT DOES ORDAIN: Section 1: That Street from Rockefeller Avenue to Oakes Avenue be improved by grading to proper grade, construction of Portland cement concrete pavement or by the construction of Bituminous pavement with curbs End gutters, installation of necessary drainage and doing all work necessary to make a com- plete improvement, all according to the plans and specifications prepared under the direction of the City Engineer, which plans and specification: are hereby adopted and approved . The original petition filed herein asked that bids be called on both types of pavement and after bids are received the City council will decide on the type of improvement to be made. Section 2 : That the cost and expense of sa iii improve- ment, including all necessary incidental expense, shall ee borne by and assessed against the property included in the assessment district herein created in accordance with law. The City of Evertt shall not be liable in any manner for any portion of the costs an. expenses of such improvement , except as provided by Chapter Ittla 141 Session Laws of 1923, or acts amendatory thereto, and the ordinances of the City of Everett. Section 3: That there is hereby established a local improvement district to be known as "Local Improvement District No. ..5 6, 2 ", which district shall include the following des- cribed property:
