<br /> An Ordinance requiring permits for the operation of
<br /> restaurants and bakeries,prohibiting the sale of adulterated,
<br /> unwholesome or misbranded food or drink, providing standards
<br /> of sanitation, and regulating the inspection of such establish-
<br /> ments , the enforcement of this ordinance , End the fixing of
<br /> penalties, and declaring an emergency.
<br /> THE CITY OF EVERETT DOES ORDAIN:
<br /> Section 1. Definitions:
<br /> (a ) Restaurant - The term "restaurant" shall mean
<br /> restaurant , coffee shop, cafeteria, short order cafe, luncheon-
<br /> ette, hotel dining room, sandwich stand, soda fountain, and all
<br /> other eating and drinking establishments.
<br /> (b) Employee - The term "employee" shell mean any
<br /> person who handles food or drink during preparation or serving,
<br /> or who comes in contact with any eating or cooking utensils,
<br /> or who is employed at any time in room in which food or drink
<br /> is prepared or served.
<br /> (c) Eating and Cooking Utensils - "Eating and cooking
<br /> utensils" shall include any kitchenware , table ware , cutlery,
<br /> utensils, containers, or other equipment with which food or
<br /> drink comes in contact during storage, preparation or serving.
<br /> (d) Health Officer - The term "Health Officer" shall m-an
<br /> the health authority of the city of Everett or his authorized
<br /> representative .
<br /> (e) Person - The word "person" shall mean person,
<br /> firm, corporation or association.
<br /> (f) Bakery - The term "bakery" shall mean any dace
<br /> used for producing, mixing, compounding, or baking for sale or
<br /> use in any restaurant , shop, hotel, or other place any bread,
<br /> pies,biscuits, crackers, rolls, macaroni, or other food products
<br /> of which flour or meal is the principal ingredient .
<br /> Section 2: Permits.
<br /> It shall be unlawful for any person to operate a
<br /> restaurant or bakery in the City of Everett who does not possess
<br /> an unrevoked permit from the Health Officer and in whose place
<br /> of business such permit is not posted in a conspicuous place.
<br /> This section shall apply to temporary or itinerant as well as
<br /> to permanently established places of business. Only persons
<br /> who comply with the requirements of this ordinance shall be
<br /> entitled to receive and retain such a permit. PROVIDED that
<br /> owners of restaurants or bakeries established before June 18,
<br /> 1940 , who were operating said establishments on that date shall
<br /> have until September 1, 1940 , to comply with items 1, 2, 3, 4,
<br /> 6, 8, 9 , 12, 14, 15 and 16 of Section 5 of this ordinance, and
<br /> until January 1, 1941, to comply with items 5, 7 , 10 , 11,, 13
<br /> and 17 of said Section 5. All permits shall expire on the 31st
<br /> day of December of the year in which they are issued. T'o
<br /> permit shall be transferable .
