y J S • ORDINANCE NO. 2541 AN ORDINANCE providing for the improvement of Hoyt Avenue from 42nd Street to 44th Street by the installation of a six inch water main, its necessary appurtenances and doing all other work necessary to make a complete improvement, creating an assessment district, creating a Local Improvement District fund- therefor and providing that payment for said improvement be made by special assessments on the property in said dis- trict under the mode of "Payment by Bonds". WHEREAS, a majority petition of the property owners petitioning for said improvement has heretofore been filed with the Commissioner of Public Works and the said Commissioner has heretofore found the #pings set forth in said petition are true, and, WHEREAS, said Commissioner of Public Works has filed with the City Council alldata and information as required by law,' and, WHEREAS, said Commissioner of Public Works has recommended that said improvement petitioned for be made and it appearing to the City Council that public convenience and necessity require such improvement to be made, now, therefore, THE CITY OF EVEft1 TT DOES ORDAIN: Section 1: That Hoyt Avenue from 42nd Street to 44th Street be im- proved by the installation of a six inch water main, its necessary ap- purtenances and doing all other work necessary to make a complete improve- ment according to the plans and specifications prepared by the City Engineer, which plans and spec ifi cat ions are hereby adopted and spproved. Section 2: That the cost and expense of such improvement, including all necessary incidental expenses shall be borne by and assessed against the property included in the assessment district herein created in acc- ordance with law. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement, except as provided in Chapter 141, Session Laws of 1923 and Ordinance No. 2126 of the City of Everett.
